K-1 visa help!

Hello ,

My fiancé and I are having a hard time understanding the k-1 visa

I am a us citizen, she was born in french polynesia making her a french citizen...

we were suppose to get marry July 12 in tahiti ( french polynesia)

but our lawyer told us that by doing so the process could take between 1yr to 3 yrs. we cannot afford to wait all this time because she needs to go to colleges in the usa

my question is

can we get married in the USA and start the K-1 visa aplication?

if not is there any visa that will let us come to the USA and get maried?

Oh why oh why do we have such stupid lawyers lol, still need to ratify this situation, the K1 visa is a fiance/e visa which is issued in the home country of the fiance/e of the US citizen, this visa can take quite a while to put into place, please read the guides on Visa Journey, you can find them at the top of the main page. What ever visa you decide to do it is going to take time. If you allow your fiancee to enter the USA with the intent to marry that would be illegal and she would get deported for it.

Now you could marry in your fiancee's country and then go for a K3 visa which does not take 3 years, well ive never heard of it taking 3 years. As i've said read the guides and then decide on how you are going to tackle the situation.

You need to apply and get approve for a K-1 visa first before your fiancee can actually enter the US for marriage. There's no other way around it. If you do decide to get married in Tahiti you will now need to file for K-3 visa in order for your spouse to immigrate to the US and that usually takes longer than K-1.

03-02-2007 Medical

03-09-2007 Interview

03-16-2007 Visa in hand

03-23-2007 flight to SFO

05-04-2007 civil wedding

09-07-2007 AOS interview

The K-1 visa is for coming to the US to get married in the US. It takes 6-9+ months to get.

If it is very important that you marry in Tahiti, you might want to investigate the Spouse (immigrant) visa available by filing your petition with the consulate in Fiji---it is not clear whether they will let you file there since you don't live there, but it is worth your while to do some investigating.

If you can not do the DCF (direct consular filing) and you must marry in Tahiti on July 12, you do not have any options for this school year.

I'm not clear from your post that you understand any of the terms I've used. If you are on short time and are unfamiliar with everything, I highly recommend that you re-contact a lawyer to help you. Ask your lawyer about filing for a spouse at the Consulate. Not all lawyers are aware that you can do this.

Is the OP's fiancee already IN the US on a student visa? (I noticed college in the US was mentioned) The post isn't clear where she is residing currently..

Applied for K1

Met online 2001 - just aquaintances

Sept 2002 - 1st US visit - everything goes perfectly.

Dec 20th - Forms recev'd at CSC

Dec 27th - NOA1 received by snail mail!

Dec 29th - 'Touched'

March 10 2006 - NOA2!

March 23 - recv'd at NVC

March 24 - petition sent to London

April 9th - Pkt 3 rec'd!

May 17th - Pkt 3 signed for at London Embassy

May 24th - Medical

May24th - Pkt 4

June 14th - Interview 10am - APPROVED 1pm!!

June 16th - Visas received in my hot little hands 1pm :)

July 19th - flying to US!

July 27th - Married!! :-)

Aug 7th - Applied for SSN in married name

Aug 9th - SSN received
