k-2 visa time limits of one year from issue of k-1

we are nearly out of days for the kids to come on follow to join and us embassy manila wants more documents our marriage certificate and dna test for my wife and her eldest daughter has anyone got an extension on the one year limit for a k-2 visa

Not sure I've heard of an extension. You'd most likely have to file for a separate immigrant visa once the year expires.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Exactly. Some consulates require this. A copy of the marriage lisence is always required for a K-2 to follow. I am not aware of any process to extend other than filing an I-130 and waiting. Good luck

Do you mean the marriage license or marriage certificate? I guess it depends on the country, but in the US a marriage license only grants legal permission to marry, whereas a marriage certificate indicates the couple were actually married.

Also, how does a marriage license/certificate prove anyone is a biological parent? Wouldn't the child's birth certificate prove this?

Sorry to ask so many questions, but I'm in the final stages of preparing my initial petition, and my fiancee and I have been trying to figure out how we'll handle the paperwork for her kids once the time comes for her to deal with the consulate.

Marriage certificate, sorry. Actually, in Vermont, it is one and the same document. The lisence has a place for the officiator to sign off and then the lisence becomes the certificate. But, yes, I used the wrong term, but the certificate is always required for the K-2 (to follow) visa. It is not required for the K-2 if issued at the same time as the K-1 (obviously)

It has nothing to do with parenthood. Your fiancee was issued a K-1 which requires her to get married within 90 days of arriving in the USA. Now you are back looking for another visa derivitive of her K-1. You need to show she complied with the terms of her K-1. The marriage certificate does that.

The birth certificate proves she is the mother of "A" child. A DNA test proves she is the mother of "this" child. Some high fraud consulates require this.

Good that you are ahead of this.

We'll be filing for the K2's at the same time as the K1 unless her ex-husband flat out refuses to sign the quit claim for the 17 year old. In that event, we'll file for the 17 year old in January, after she turns 18.

Bribe the ex-husband as your plan A. It is usually the cheapest and fastest route.
