Is there a time limit in which we have to file AOS? we're saving up for it and im just not sure if we can take the time we need or if we run out of time?

You should def file within 90 days. Otherwise, you are out of status once your I-94 expires.

Not quite. They have to get married within 90 days. Adjustment of Status does not have to occur asap.

Yes married within 90 days, but it is often posted on here you should file AOS before your I-94 expires because you are technically out of status. Not to mention, if there is an emergency you cannot go home, etc.

not so much worried about going home for any reason, im just worried about being denied, is there any reason i would have problems with my aos if i wait past the date my I94 expires?

Probably no. But filing asap will also (in addition to not being out of status and unable to travel) give you the opportunity to file for EAD at the same time. If, as I understand, money is tight... this maybe a reason good enough to file right now...

ya it is tight, to the point that we dont have the money to file right now, thats why i wanted to make sure we would be ok filing later. thank you

If you can beg borrow or steal the money, get it done as soon as humanly possible. The US is not a kind place to be lately if you are "undocumented".

I moved to the US in April 2008 and we didn't file AOS until December 2008 for exactly the same reason. We were just fine and I got my Welcome to the United States letter in the mail last week. Reba is right though, try to do it as soon as possible. You shouldn't have a problem with the actual AOS though, as long as you don't encounter a situation like Reba describes. That's my opinion though!

December 6, 2008- AOS package mailed

December 8, 2008- Package received

December 15, 2008- Check cashed! WOOHOO!

December 22, 2008- All 3 NOA1's received

January 5, 2009- I-485 transferred to CSC. Here's hoping for no interview!

January 14, 2009- Biometrics

February 23, 2009- EAD and AP received in the mail, dated Feb 14th.

April 23, 2009- Welcome to the United States Letter arrives. Card to follow.

June 1, 2009- GC received in mail. Approval date 04/09/09

Done with USCIS until 04/2011!

Yeah, I went beyond my I-94 expiry before I filed also. Mostly because my brain was mush and I couldn't stand the thought of filling out more paperwork. icon2.gif

Ditto. To make it painfully clear, "just didn't file in time" equals "out of status" equals "illegal alien" in the common parlance. (Many, many undocumented workers crossed legally on a visa and overstayed.) By marriage you have an easy path to a green card, but if you don't file it, get stopped, and run into someone who wants to make an issue of it, being married alone won't stop the process.
