Timeline

i filed an I-129F application for my fiancee at the beginning of march. that is her main intention for coming to the States. however, she also wants to attend school while she is here, but we're worried that the K-1 visa process will not be complete by the beginning of the fall '09 semester. once accepted by a university, she can take the school-issued I-20 form to the consulate and try to get an F-1 student visa, which would allow her to come here 30 days before the start of the semester (beginning of august).

is she allowed to file for the student visa while the I-129F is pending? will she be denied based on her intention to come here and marry me? will the consulate view this as an attempt to bypass the I-129F process?

TIMELINE:

03.06.09 - Filed I-129F

03.09.09 - Received NOA1

09.14.09 - RFE received

09.16.09 - RFE response sent

09.22.09 - NOA2!!!

09.28.09 - Case received by NVC

10.01.09 - NVC sent case to embassy

10.07.09 - Consulate received case, packet 3 sent via email

10.12.09 - Packet 3 checklist sent to embassy

10.21.09 - Embassy received completed checklist

12.14.09 - Appointment letter issued

01.19.10 - Interview

01.28.10 - 2nd interview

02.10.10 - Visa in hand!!!

04.01.10 - POE in Chicago

04.23.10 - Marriage

05.11.10 - Filed AOS, EAD, & AP

Timeline

Student visas are issued when the beneficiary has non-immigrant intent - not the case in your situation since that will be very difficult to prove with a pending I-129F.

Further, attempting to enter on a student visa (a non immigrant visa) with intent to adjust status further down the road is illegal anyway. Best to wait for the K-1
