can i use a 1040 as financial evedence

Timeline

I submitted my 2008 w2 as part of my financial evidence however the asked me for proof of my returns can i use a 1049. they sent along with interview letter a check list which states that my wife has to show financial evidence how ever the operator told me they require the proof help.

You need to get tax transcripts from IRS to establish proof of having filed. 1040 doesn't prove anything!

IRS 800 829 1040 24/7 FREE. Takes about a week snail mail. Can get faxed in 1 day during business hours.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Copy of tax return (1040, 1040Ez, etc) along with supporting documents (such as 1099's, W-2's etc.) are acceptable. Can order IRS transcripts (free) and submit those as proof as well. :thumbs:

Yes, corrosponding 1040/W-2/1099 as applicable.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

That's correct, one is not valid without the other. So if you only sent your W2s, then you need to send a copy of the corresponding tax return. Same goes for the people who only sent their 1040s without the corresponding W2s. Now, if you don't have one of the two or both, then you can contact the IRS and get a copy of your tax transcripts which can be used in lieu of the 1040s and W2s.

I have them both on was submitted and one wasn't but the 1040 i have CAME FORM MY TAX FILER . does it need a stamp or something form IRS

Tax transcripts are sometimes asked for. Especially self employed without 1099s.

No, a simple photocopy of both, the 1040 and the W2 is all you need. Do not send original documents for this.
