After my fiancee arrives we have 90 days to get married, correct?

Then we have 90 days to file for AOS so she can get her 2 year GC, correct? What if I do not do this within 90 days? It seems people can do this after 90 days and there is no penalty

Then how long do we have to wait to remove conditions so she can get her 10 year GC?

From what I understand, you want to file for AOS right after getting married, before the first 90 days is up.

The conditional green card is good for 2 years.

You have 90 days on entry to get married.

After that, your suppose to file for AOS before your I-94 expires (which happens to be 90 days on entry).

If you wait, you will out of status, subject to deportation. It will cause problems if your stopped by ICE.

If you wait pass 180 days or more, and then AOS, your AP is useless, as you just aquired enough overstay to invoke bans, even with an AP, if you leave the country.

So - in a nutshell, DO NOT wait for AOS. File as soon as possible, in order to avoid any issues.

Yes - some people go past the I-94 - and some have some issues, but some have no issues - up to you...

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
