When filing i130 for child

When we file the I-130 for my 6 year old daugher do we need to include a g325a with these. And if so do we need one for petitioner and one for my daugher.

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

Removing Conditions Begins

Mailed I-751 April 12th 2008

signed for @ NSC April 16th

NOA date April 16th

Conditional GC expired May 5th 2008

Biometrics Detroit May 10th 2008

10 year Green card ordered August 20th 2008

Hello Buttons,

The I-130 instructions mentions the G-325a only under section a: husband or wife. It outlines what documents are needed in a parent/child or stepchild relationship (page 2):

B. A child and you are the mother: Submit a copy of the child's birth certificate showing your name and the name of your child.

C. A child and you are the father: Submit a copy of the child's birth certificate showing both parents' names andyour marriage certificate.

D. A child born out of wedlock and you are the father: If the child was not legitimated before reaching 18 yearsold, you must file your petition with copies of evidence that a bona fide parent-child relationship existed between the father and the child before the child reached 21 years. This may include evidence that the father lived with the child, supported him or her, or otherwise showed continuing parental interest in the child's welfare.

H. Stepparent/stepchild: If your petition is based on a stepparent-stepchild relationship, you must file your petition with a copy of the marriage certificate of the stepparent to the child's natural parent showing that the marriage occurred before the child's 18th birthday, and copies of documents showing that any prior marriages were legally terminated.

In the checklist on page 4 it only reminds you to submit the photo and G-325a under the heading "If you're filing for your husband or wife". I would venture to say that it is NOT needed for the parent/child relationship.

The answer to your question is NO. The G-325a form is not required for a child. We just filed ours back in May....the I-130 for my wife, yes...the I-130 for my step daughter....NO. Hope that helps.

whewww... I didn't file a I-130 for my stepson either but was worried that I didn't follow instructions and should have filed.

I was counting on the K-3 to finish first and if there was a problem, just do his AOS here.

But it seems that the K-3 is not going to finish first... so now i'm worried about not doing a I-130 for my stepson.

its enough to make you drink... daily, hourly :wacko:

should we even file a i-130 for my daughter, can we do aos without it? This is so confusing. We are just waiting for the packet 4 for the K-3. Any suggestions would be of help!

You will have to file the I-130 to do the AOS. The child is not eligible to enter the US because the parent got an approved CR1 or IR1 (through I-130 process). So, unless you have another legal way for the child to enter, the AOS is not possible. You will need to file the I-130 which will need to be approved for the child as well.

If the step child enters on a K-4 visa you will still need to file a I-130 for the step child at some point in order for the child to adjust status. So you can file the I-130 now...which would be needed to enter on a cr-1 or file later which is needed to adjust status on the k-4....it just depends on which way you wish to go...we filed the I-130 for both my wife and step child as well as the I-129f for the K-3/k-4....i figured i would have to file it anyway at some point so why not now......hope this helps.

We had the same problem. You will have to wait for the K3 and file I-130 in the US at AOS. There is nothing else that can be done, unless you want to file the I-130 for the child now and wait for it to catch up. Really point in stressing over it, I did alot of that......you just have to go with the K3 & 4.
