If Unemployed, What Does One Put On the I-134?

Line #7 on the Affidavit of Support form - I am employed as or engaged in the business of ...

If we do not have a place of employment, what do we put? I am technically at my job (I am currently on "paid leave") until June 1st, but I've already got my sponsor lined up, as it's very likely that my fiance will have his interview after June 1st. This one question is killing me. I've searched all over VJ for an answer, and I don't think I can just leave the line blank. :help:

Unemployed might be a proper answer but assess when you have an interview... you may have a new job by then

You answered your own question. You are now employed (to sit at home but if you are being paid) you are employed

I'd fill in the I-134 form with the information that is current on the day you send it to your fiance(e). It doesn't matter what happens in the future.

You'll have to resubmit new employment information when you AOS and then you fill in the info that is current on the day you fill out the form.

Make sense?

You answered your own question. You are now employed (to sit at home but if you are being paid) you are employed

I'd fill in the I-134 form with the information that is current on the day you send it to your fiance(e). It doesn't matter what happens in the future.

You'll have to resubmit new employment information when you AOS and then you fill in the info that is current on the day you fill out the form.

Make sense?

Always read carefully and interpret literally. "Employed" and "working" don't share a common definition. Ask any "employer". :thumbs:

The answer is "unemployed" IF that is the situation when you complete the I-134. It is not the situation today. As for income, if you are receiving unemployment compensation, you can enter the amount you are receiving at the time. It may not be an "acceptable" for of income, but it IS income and it is truth. You have a co-sponsor, so that should cover the problem.

If you are currently on "paid leave" you are currently still employed, but if the I-134 is completed after that time, well, you have to answer truthfully. The official position of USCIS (for the I-864) is that all income documentation must be current within 1 year, but individual consulates have wide latitude on what they will accept for the I-134 and can ask for more current information. Most consulates apply basically the same rules as the I-864. You can check in the regional forums for someone with experience with the particular consulate you are dealing with.

For our K-2 visa (to follow) interview in June, I will use the same employment letter as for the K-1 interview last August. I have confirmation from the consulate in Kiev, it is acceptable if dated within 1 year. Of course, I will update the check stubs and have a new tax return and w-2 to submit.

Exactly correct. Her question was what she should answer IF unemployed. And my answer was "unemployed" IF that is "the situation when you complete the I-134. It is not the situation today" :thumbs:

Yes I am technically employed now, but I will most likely NOT be employed by the time my fiance is scheduled for his interview, and that was when I was going to complete and send the I-134 to him. If I can send it NOW, then I will enter my current employment, but I'm assuming that they want the most current information; if the interview is scheduled for July, I'm guessing that employment verification from a couple of months prior is not going to be sufficient.

Your assumption is incorrect. I-134's executed with supporting documents submitted within a reasonble time are routinely accepted. I sent mine two or three months ahead of the interview. I-864's for immigrant visas are commonly submitted several months before the interview. Financial facts are snapshots on a given date. Nobody knows for certain what the snapshot will look like tomorrow.

I've already completed my I-134 for a planned interview in June for a K-2. No worries.
