K1 pending can I apply for F1 visa?

Hi,

I applied for a k1 visa and based on the timeline I should receive the NOA2 in 2 months.

I was wondering if I can apply in the meantime for a student visa.

I would like to study in the US but I think there is a conflict between the two visa.

Will I be able to study only once my k1 visa is approved and I get married?

A K-1 is allowed to study at a school, this is NOT a problem.

The only issue may be with the college, it they are state funded, you may be charged non-resident rate until you have been a resident for at least 6 months or a Year depending on state.

Why did you let your fiancé petition for you if you have plans to study in the US? Why didn't you just apply for an F-1 visa right away? Much faster... Now I think the F-1 visa will be difficult, if not impossible. With your fiancé's petition, you have stated an intent to immigrate, and in order for an F-1 to be approved, you have to "prove" that you have the intention to leave the US after the end of your program. This "proof", in my case, has simply been a signed statement that I intend to return, which I did. I doubt they will accept such a statement if you have declared an engagement to a US citizen.

At least when she's on a K-1 she becomes a permanent resident, and doesn't need to pay non-resident tuition for more than a year. On an F-1, she (or the school if she has a fellowship) will be paying it all the way through. Unless, of course, she were to decide later to get married and adjusted status from the F-1. But since she has the intention of getting married already, the F-1 is not an option anymore.

For the Arizona state universities, to get resident status (for tuition purposes ONLY) you only need be married to a resident of the state (according to tuition purposes residency definition).

Of course, if your fiance was recently a student and has been (or still is!) dependent on their parents then this wouldn't necessarily work out...

I don't see where you are moving to, so I can't help you specifically there. A really fast google web search with "<your hoped for university> residency requirements" will probably get you what you want. Look for something like this:

1. I am financially independent and:

* I established a domicile in Arizona and have been physically present continuously for twelve months prior to the start of the semester for which I am requesting residency, and

* I have not been claimed as a tax dependent by any other individual in the last two tax years, and

* I have demonstrated the intent to be an Arizona resident for twelve months, and

* I have been completely self-supporting during the last two years, including paying my own tuition and living expenses from self-generated funds.

If the above statement is true then you should fill out the Independent Petition

5. I am married to an Arizona resident who meets the financially independent requirements (see above) and:

* I have followed Arizona state laws regarding intent on or before the appropriate petition deadline, and

* We were legally married on or before the appropriate petition deadline, and our marriage is recognized by the state of Arizona.

If the above statement is true then you should fill out the Arizona Spouse Petition

I was asking this because I know that the K1 visa will take a long time (I am with VSC) and I wanted to start a master on September. For sure my visa will not be ready for that time so I was trying to figure out how to start college on time.

You're cutting the (college) application deadlines a bit close, aren't you?

Maybe you get the K1 visa and then start in spring semester (next January).

The application deadlines for the fall are most likely past, so do you have an application in and are already accepted into a program? You need to be accepted into a program and have funding in place in order to apply for an F-1.

However, as I said before, I don't think the F-1 is an option for you anymore. But I wouldn't rule out the possibility that you get the K-1 by September.

Perhaps the OP was going by the times he saw other people getting approved. I also believe (hope, pray) that I'll be approved a 4-6 weeks ahead of the VJ estimate.
