Hi everyone. I already posted this but have not gotten a response in the other forum. I should have posted here first, I always get a faster response from you guys anyway!!

So, am I allowed to go back to Canada while my AOS or EAD is pending?? I noticed on the back of my I-94 that is says you have to surrender it anytime you leave the US. That number is what is on all my forms though.

Howdy Lincoln,

You can go back to Canada only once you receive your advance parole, AP. This you apply for at the same time as AOS/EAD. Which can take 60-90 days on average. Do not ever try and go back without AP, or you can't come back!

See, that's what i don't get. K-3 has multiple entries I thought.....

You entered the USA on a K-3 visa. K-3 is MULTI entry visa, it allows re-entries from trips abroad. The directions for form I-131 states that I-131 does NOT need to be filed for K-3 visas because of it's multi-entry status.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

NOTE: If you are in the United States and wish to travel abroad, you do not need to apply for advance parole if both conditions described below in A and B are met:

A. You are in one of the following nonimmigrant categories:

1. An H-1, temporary worker, or H-4, spouse, or child of an H-1; or

2. An L-1, intracompany transferee, or L-2, spouse or child of an L-1; or

3. A K-3, spouse, or K-4, child of a U.S. citizen; or

4. A V-2, spouse, or V-3, child of a lawful permanent resident; and

B. A Form I-485, Application to Register Permanent Residence or Adjust Status, was filed on your behalf and is pending with USCIS.

However, upon returning to the United States, you must present your valid H, L, K, or V nonimmigrant visa and continue to remain eligible for that status.
