Time frame for legally staying in the United Kingdom

Called DOS today because last time we emailed them asking for an interview change they did it on the same day and even though they did not email back, we called DOS the day after emailing the embassy and they had the new date and packet 4 date for us. In the email we sent the embassy yesterday, we asked them for advice and also wrote for them to extend the date if there is no other possible way for him to be allowed to interview on May 12. I don't know why but calling DOS today gave me some hope that maybe...just maybe...the US Embassy has a solution for us since they have not postponed his interview date...or it could just be that they did not get around to figuring out what to do with us...:wacko: But at least I asked about my fiance's medical and whether it has been entered in the system and I was given a positive, yes it has been entered in the system. Of course no passport today either, which really is so frustrating there are no words to explain...we are still hopeful and expecting something good from the US Embassy, whether they give us a new interview date, allow him to interview on May 12 or extend our NOA2 approval (which expires June 03 or 04 by the way), anything to help us out would be wonderful.

Updating...no passport yet of course!

DOS says he can interview as scheduled and gave us instructions on what to take as evidence of why no passport. Still no replies from the US Embassy regarding our requests, but we got what we needed for him to go tomorrow.

Recap of past events:

05/06/2009: (Wed) Emailed embassy requesting counsel/advice regarding our "no passport yet" situation.

05/08/2009: (Fri) DOS: Interview date is still May 12

05/08/2009: (Fri) Emailed embassy again but this time to ask for extension of the NOA2 for another 4 months

05/11/2009: (Mon) DOS: Interview date is still May 12

***Still waiting for email replies from the embassy on both requests***

***Will be interviewing May 12 (as scheduled)

Not yet, and it is worrying me that if we get the passport later, the visa will be delayed even more because of the supposed backlog at the embassy. So this is the last week we are waiting for the passport, then we will just call the UK Home Office and ask for a withdrawal of his application, that is the only hope we have left, because whenever we called before, they told us it is still "in processing" even though it is NOT, it has already been approved, but we have to say whatever they want to hear from us in order to get the passport back ASAP. So this week is the last week we wait and then next week we call and ask for a withdrawal.

Once he withdraws his application (even though he has already been approved :wacko:) he has by law within 28 DAYS in which to leave the UK, so I am sure that is way more than the time he requires to get his visa back from the embassy and leave. It is not as much stress as we have dealt with so far, believe me :yes:

And only 8 more days till you land in Chicago! :dance: Everything set to go?

Yes all set!! Can't wait. I finish work Thursday & I'm officially in party mode from then on.

I was hoping to have Monday & Tuesday off to recover but I'm out again Monday for dinner with friends & then Tuesday evenin with another friend for a couple of nightcaps to calm the nerves before the flight & POE! She promises not to get me drunk! lol

Good luck with the passport..it will all fall into place soon. :star:

Update: We withdrew his "supposedly under processing" student visa application and the UKHO confirmed his address and then told him that he will get his documents and passport returned to him within 10 business days (by June 05, 2009). Hope we get it back before then!
