Why not apply for 2008 tax return after spouse gets here?

As an FYI...the consulates have the right to ask for 2008 returns during the interview. In my case, I filed my 2008 return and will ammend it later once my wife gets her SSN.

Yep. That's why I emailed Chennai Consulate and got a response back that they will accept the copy of extension form with me (petitioner) writing a letter as to why I filed extension form. I will print out the email as well as send copy of 08 tax extension, W2s, 1099s, and other tax related stuff I've to my husband so he can take all that to interview.

Cool. I was thinking about doing the extension but then decided that I should just file my tax return and ammend it with my wife's information later. I am owed money, so once I ammend it I get more money back.

Nice.. I am more than likely going to owe money to IRS, at least that's what happens to me every year I hope being married helps in this department

It definitely helps, as you can claim another exemption, and your tax bracket is lower.

I wouldn't think the spouse would qualify for the 2008 stimulus as he was not a resident alien for any part of the year. Having a valid SSN is only part of the equation.

If you were married in 2008 then they qualify

My W7, marriage contract and affidavit of my passport are all ready.. I just really dont know the exact FORMS that my husband needs to fill up.. is it

1040 or 1040EZ??

I still want to apply for ITIN... IF NOT, can someone send me the form for Extension? Where and how can we submit this?

Are you the U.S. citizen? I'll assume you aren't in order to respond.

You have to have a notarized copy of the non-resident alien's passport. The notary has to be done at the US Embassy in the non-resident alien's country, or if you live in the U.S. you can use an acceptance agent or someone else that is able to authenticate foreign documents. I'm not sure what you mean by "affidavit of my passport".

Also, you have to write a letter explaining the you (the non-resident alien spouse) elect to be considered a US citizen for tax purposes and have your worldwide income taxed by the IRS. See http://www.irs.gov/publications/p519/ch01.html#d0e1603 Nonresident Spouse Treated as a Resident.

What form you use depends on your tax situation. You could use 1040, 1040A or the 1040EZ. 1040A is the long form for itemizing if you have a enough deductions (medical, mortgage, etc). 1040EZ is if you have no deductions and the 1040 is the average situation. I'm speaking in general. I would recommend that you go to the IRS website and look at the forms.

The W-7, the other documents and the 1040 go to a unique location, not where you would usually mail the completed tax forms. If all is in order they assign an ITIN, then they forward the completed 1040 with the new ITIN attached to appropriate branch of the IRS to process the 1040s. I read it takes 4-6 weeks to get an ITIN.

There is a free version of TurboTax on the web. You MIGHT be able to use it to fill out the forms, but you can't use it to file income taxes since you don't have a SSN. MAYBE, you can print the results after completing the forms. This is an untested idea, and it might not help you in your situation. http://turbotax.intuit.com/personal-taxes/...ree-edition.jsp

If nothing else, you can see what's available. I used TurboTax software (not the web version) to fill my forms then I printed them out so I can mail them.
