Is it ok to apply for ITIN?

I am about to send this W-7 Form together with my notarized and affidavit of passport and original marriage contract, however we are already preparing the documents for the AOS since we already paid it.

Is ok if I will still pursue to apply for ITIN or will it cause any confusion with the AOS papers?

Please give me some advise about this.

Its ok to apply for an ITIN. When sending the AOS papers are you sending your 2008 tax returns? If so then you probably need to include copies of the W-7 application for the ITIN with your AOS papers.

Alternately, you can file as single, and ammend the tax return later.

Its ok to apply for an ITIN. When sending the AOS papers are you sending your 2008 tax returns? If so then you probably need to include copies of the W-7 application for the ITIN with your AOS papers.

My husband has his w2 and the 1040s for 2006, 2007, and 2008.

So we need to include the Tax transcript from 2006 to 2008? The lady from the IRS said that they will not yet release the Transcript for 2008..

Your original marriage contract should be submitted with the DS-230. don't send it with the AOS.

For your AOS, with regards to the tax return info:

Submit W-2 and Tax Transcripts for 2006 & 2007

Submit W-2, 1040, 1099s, W-7 and relevant proof for 2008.

And then include paystubs and employment letter if you have it.

Your original marriage contract should be submitted with the DS-230. don't send it with the AOS.

What im trying to say is that i am going to submit the affidavit and notarized passport with signed by the judge for me to apply for ITIN not for AOS and DS230 hehe

queuedup, Which form should my husband use? 1040EZ or only 1040? I want to send my documents to him so that he can file it on Monday. My papers are all ready.. I just want to know which form he should have to fill up.

I believe since you are filing for an ITIN you have to use form 1040 since it will also be a joint return. Good Luck!!!
