It is not illegal to enter on the VWP to get married. Keep in mind, however, that you will have to go home at the end of the 90 days just like any other visitor-the VWP is *not* for immigration purposes and to do so can cause repercussions for you down the line. You will be asked to prove that you did not have intent to immigrate when you entered, and the burden of proof will be yours.

You can, however, come over, marry, and file for a spousal visa (k-3). So yes, you are on the right track, so long as you understand that attempting to immigrate using the VWP *is* visa fraud and you will have problems if you try and do so.
