hey all

our file is approved on 23 january and we've sent all docs needed.. but in last lawyer asked for original birth and marriage certificate.. we'd given him those yesterday .. he said he has submitted DS -230 and now he will submit BC and MC.. how can it possible.. upto my knowledge we've to send original certi. along with DS-230.........

so what sould i belive??? had he sent DS-230 before and now sending BC and MC or he'd not sent anything yet and misguiding us??

so my case is not complete yet, right.. he says yet 2-3 weeks NVC will take to review our case.. so is it possible by any means to get interview date in May??

the wait seems enldless to me ...

i want to call to NVC to check my case status to know what our lawyer is actually doing. can anyone give me the numbar and i'm in india so,in which time i can call?? do they ask anything else than case number?? pls guide us.

Case complete: 04-20-09

Interview date: 06-08-09

finally i called to NVC but the AVR sys saying they hv not received our case...........

what should i do now??

you were approved on Jan 23 .and still till now NVC didt get ur case ?!

i think ufirst need to call USCIS and find out when exactly they sent the petition to NVC

be advised that the AVR sometimes have alot of problems ...

i seen ppl got their case complete in NVC and they never put in the AVR system ..so dont panic ..talk to an operator in NVC first ..if its there (which im pretty sure of ) so u have nothing to worry about ..then ask her/him wht documents are there with ur petition to find out about ur lawyer

if he is playing ..dont hesitate to face him hardly ..

Good Luck

Seems like a red flag in many ways. The most important thing is what kind of relationship do you have with your lawyer? You should be getting clear communication and timely information from the person you have working FOR you. I decided to use a lawyer even though I know the lawyer slows the process a lttle for me. My lawyer is slammed with H1b applications right now but still communicates advice and process. I also call NVC often and read forums and prepare the details with my wife. I am not sure what you want to do, but communication with the person you pay is first.

Good luck on your journey

K.D. - It can be the case that the MC and BC were not included in the submission of the DS-230, and that the lawyer now needs to send them in because an RFE was issued. I suggest you first call or have your husband call NVC, speak to an operator and find out the exact status of your case :) This way you will know exactly where you stand in the process.

No problem. Also if you are going for a CR-1 visa, you should change your profile to reflect that, so that statistics on VJ can benefit from your timeline. Good Luck!!

dont listen to the AVR when you call NVC. Up to the point of our case being completed at NVC and sent to the Embassy, the AVR always said the same as yours. always talk to a real person!

i totally agree...i don't remember how many times i have said this, DO NOT RELY ON NVC AVR to give accurate updates on your case status...ie...last AUG we went through the ENTIRE NVC process and even after our case was complete, our AVR still read "NO RECORD FOUND"...and now that we are already approved and issued a NVC case # for our additional I-130, our USCIS case status still reads "received and pending" ...speak to a LIVE operator...it is possible he sent the DS-230 without the required documents (maybe he sucks as an immigration attorney) which would, as the quoted poster said, trigger a RFE.....CALL NVC......good luck

Until recently, NVC only used to require photocopies of all civil documents. Now NVC requires originals. Unfortunately, many immigration lawyers does not keep up with the rules, and kept submitting documents like they always have in the past. I agree with the previous posts, your lawyer may have just submitted photocopies and received a RFE, now he probably needs the originals to complete the case.

Do call the NVC and confirm the status of your case. If you already paid the IV bill, which allows your lawyer to send in the documents in the first place, then your case definitely should be at the NVC.

Hi there, if you want to call the NVC, you can use this number #001603 334 0700.

When some one answer the call just say your case number, name, date of birth and the petitioner's name and date of birth. Then you ask your question.
