Timeline

Hello everyone and thankyou for responding

We just recieved our K-1 approval but instead of being forwarded to the NVC for final clearance ,it was forwarded to the Indonesian consulate. They have not recieved it yet. My question is has anyone gone this route before. I scanned all these posts and all say it must go to the NVC first.

Please help

I've seen this claim a few times in the last couple days. What leads you to believe that the NVC was bypassed?

K1: 01/15/2009 (mailed I-129F) - 06/23/2009 (visa received)

AOS: 08/08/2009 (mailed I-485, I-765, & I-131) - 10/29/2009 (received GC)

If you read the thread of topics I have posted... thats not true. All K 1 VISA will go through the National Visa Center. It will not be directly forwarded to the consulate of the country. As for my case, NVC did not receive my case yet.

I suppose, you can try calling NVC to check to see if they have received your case.

As far as I know, yes, you are correct.

That's bizarre. Did the text on your form look similar to (or the same as) S.IS.Hwang's (see http://www.visajourney.com/forums/index.ph...188802&hl=)? I'm under the impression that it ALWAYS goes to the NVC, but I'm not sure why they would tell you that the app is being sent to the embassy instead of the NVC directly on the actual NOA2 if it isn't true. My NOA2 didn't say this. I guess one of the following must be true:

  1. They recently changed the wording on the NOA2 and, for some reason, left out mention of the NVC even though it is still a part of the process
  2. Your situation is some sort of special case
  3. The form is simply wrong and someone screwed up at USCIS

It is simple. The USCIS processes all petitions, they are part of the Department of Homeland Security. The State Department processes all visas. The USCIS approves a petition and sends it to "the consulate". Consulates are part of the State Dept. The State Department has determined that it wants ALL visas sent to the consulates THROUGH the NVC. As far as the USCIS is concerned, they are done witth it (for now) and have forwarded to the "consulate" it is not their decision or within their control to choose the route the petition follwos to the consulate.

After approval and when your finace(e) enters the USA, her visa is CANCELLED upon entry and the State Department is once again "out of it". Your fiancee turns over her secret sealed packet to the CIS at POE and is issued an I-94 valid for 90 days. This replaces the visa which is only a document for entry. The papers are now sent to the USCIS again for the AOS process. After green card approval you case is kept at the local office of CIS and remains there until you move out of the area (it would be sent to your new local office) or your fiancee becomes a citizen at which point it is shipped to the warehouse you see at the end of the Indiana Jones movie, those were all K-1s in that warehouse. The (smaller) K-3 warehouse is under a Walmart in Oklahoma. (You read it here, it MUST be true)

ALL visas of any type go through NVC, hence the name..National Visa Center.

Thats right! My understanding is 100%, unescapable our case will go through the NVC. So, keep waiting ~ call the 603 number everyday to check to see whether the case has been received.
