It is common wisdom in some circles to prepare your love with three years of returns. If they ask for one then give them one. But they often ask for three so better to be prepared. Better safe than sorry so go for the overload (this coming from a guy whose I-129F was 109 pages long).

Why would they ask for the past 3 years in tax returns if it didn't matter? I have paystubs saying that I'm making enough, but not a lot other than that. I want to know because I'd rather not send just my information in and have it be denied, but I'd rather not drag my mom or sister into it if I don't need to.

Where did you see something about needing the past 3 years' tax returns? The i-134 says they're only needed if self-employed, or did I totally miss something?

Also, please link me the reference on the child support. I just want to make sure I filled out my form correctly.

I also brought 3 years worth of information, just to be safe, the 2008 return and transcripts for 07 and 06. The interviewer did not even glance at what he made for 2007 or 2006, I am assuming because 2008 was over the limit for the poverty guidelines. Did not glance at paystubs or the letter of employment either. I dunno maybe it was because he's military.

I have read on VJ and I cannot find the link for it, but somewhere I read that they use the guidelines for the I-864 at the consulate level to determine if your support will be sufficient. (No brainer right? If you can't get a visa because of poverty guidelines then no AOS) The I-864(Affadavit of Support) form for AOS asks for the past 3 years tax information submitted, employer letter, and proof of military status if you are eligible for the 100% poverty guideline

You can get tax transcripts for the past 3 years from the IRS for free! Took about a week and a half to arrive. We were not able to get 2008 transcript, because it was still income tax season but told that in August of 2009 you should be able to get the 2008 transcript. Some people if I remember correctly who were going through this the same time as me got there 2008 IRS transcript when asked for in April around the income tax filing deadline.

I brought pictures, boarding passes and a few months worth of phone records, did not ask to see them at all! Better to be safe than sorry though!

Best to check out the regional forums to find out what others have done for the specific consulate! The I-134 requirements are the for the most part universal though for each consulate.

Greetings K-1 filers...I spent the better part of the day returning home from sun-soaked Barranquilla. My Mother had a wonderful time getting out of the house, and forgetting reality for the past couple of weeks. I should probably work on that. The IRS won't let you have copies if you are divorced and your ex-spouse is on the paperwork, but I'm sure I could get copies from my former tax preparer.

I should probably work on that. The IRS won't let you have copies if you are divorced and your ex-spouse is on the paperwork, but I'm sure I could get copies from my former tax preparer.

By the way, here is the info on the I-864: http://www.uscis.gov/files/form/I-864.pdf. Number 25 is what you're looking for.

Not feeling like today is going to be super productive....I think my productivity has been cut in half since April and May filers started getting approved. :P A little obsessed....

Hey look on the bright side, you will have all the supporting documentation that you need for the I-864 for AOS now, the 3 years of tax info, no waiting or scrambling to get that stuff to send off for AOS. Oh and I am excited that we will qualify for the I-864EZ!!
