Hi everyone, got a question, I have no birth certificate. Left VN when I was 3, I notice you need to bring birth certificate to the interview. How will I obtain it if there is a record in VN. Say there is no record, what will I do?

I'm talking about my birth certificate, not my wife. Petition with USCIS I just need my citizenship which is passport or naturalization.

In Philippines, we have this "Late Registration" for those who dont have birth certificate record. I am not sure in Vietnam, let her inquire.

If you're two have the same last name, I'm very sure 100%, yes BCs are required. Otherwise, I'm not sure. I suggestion, try to get the BC for yourself. How to get it? very good question. There are 2 ways to do it,

1. Do it in US: http://viet.vietnamembassy.us/pdf/5.2%20Da...ai-Viet-Nam.pdf. Fill-out these forms, send to Vietnamese's Embassy at DC for "Hop Thuc Hoa", and then send back to Vietnam. If you want Embassy expedite your paper, you have to pay an extra money (call and ask them). also you must fill-out "Giay Uy Quyen/Power attorney".

2. Do it in Vietnam, "my friend tried, but unsuccessful". Ask your realtives help you with this, as always "Bribe" is first prior in Vietnam if you want it fast.

On your situation, if I were you, I'll do it. Do it in US, before send to Vietnam, make all copies, write a letter and explain your circumstances why you lost your BC. Attached copies with a letter send those back to your wife. If you don't receive your BC before the interview, at least you have some back-up to show the CO that you've already tried.

Go to a lawyer or a judge . Someone that licensed to practice law . Bring someone that has know your fiancee since birth , that can state the date time location and names of both of her parents . And have it notorised , they have documents in vitanam that have a notory seal too . But this will only be excepted if there is no such record of your fiancee birth , its covered within the law to have this done ( in case of naturial disasters , like fire water ect. ). But you need to have a document stating that there is no such birth excist in their records . And the explaination from them why her birth doesnt excist .

I dont think you need a birth cirtificate because many vietnamese left as refugees way back then did not have birth certificates either and still able to petition for their relatives,

addition to HAONIE,

VN embassy don't "hop thuc hoa" without secretary of state's authentication, mail your form to secretary of state for authentication before heading to vietnam embassy

How did you enter the US in the first place without a birth certificate? Use that in place of the birth certificate! I sent certified copies of my BC (done back in 1984 when my relatives filed petition for my family) and it was ok

I am in very similiar situation. We left Vietnam when I was only 6 months old. I have no birth certificate. What I plan to do is to submit the old document I have that verifies my age (notarized of course). For me that is the refugee forms and pictures that we have from our camp in the Philippines in 1985-87. I was born in '84. I hope this works. Please keep us updated on what you decide to do.

I left my birth certifiacte in Thailand. When I filed the I-130 I used a copy of my US passport, and it worked out fine. I'm not too familiar with Vietnam, but I wonder why they would need YOUR birth certificate. I can understand them needing your wife's. I would think you already proved your status in the US when you filed the I-130.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

My wife having her interview coming up May-18. Her lawyer told her that the CO needs my BC for her interview. Yes, I really don't know why they asking for my BC, since I am already submit my US passport, and Naturilazation. We only have 6 weeks left to prepare for this stupid document. I am wondering do I have time for this, OR the lawyer just want some money from us?
