PROOF OF INCOME: TAX RETURNS

My fiance is self employed. During the initial app, we filed a copy of 2007 return, and we got our NOA2 approval.

I am preparing for my interview in Montreal.

I have copies of his 2006, 2007, & 2008 returns. I also have a copy of a recent pay stub, showing what his biz pays out to him.

As he is self employed, he does not have any W2's? Is this a problem? Will I need more proof of anything? I hope what I have is sufficient.

Any advice is appreciated :)

any 1099's? or Schedule C to the Form 1040

Tax returns are useless without the supporting documents originally submitted with them (to the IRS). Supporting documents (as stated in the above post) may include W-2's, 1099's, Schedule C's etc...

To avoid having to send supporting documents - an individual can order IRS Transcripts (free) which will satisfy both the tax return and supporting document requirements.

You would need his 1099s and schedule C. The schedule C is in the copy of the tax returns you have. Good luck on your journey.

He got an approval because a tax return of any sort is not needed for the I-129f. They were probably thinking "Oh, another one that can't read instructions" Not that I would think such a thing, but hey, you know those Gov't types.

W-2s are only given to people employed as employees (not contractors) of a company. A person can own his own business, incorperate the business and employ himself as an employee, then he would get a w-2. Otherwise No. Most self employed do not get w-2s. It is perfectly legal and even desireable.

You don't give enough information about the check stubs for me to say. If he is paid by another business as a contractor then he will have 1099's. Include those. If he has incorporated his business and employs himself as an "employee" then he will have w-2s he prepared for himself. Include those. If his business is a sole propreitorship and he simply writes himself a check from the business account, then he will have neither. Be sure all his tax returns have all schedules and attachments. There should be a schedule C for each one. Get a bank letter showing deposits for the last 12 months.

Sounds like you are good to go, if you have 3 years complete tax returns. I would throw in the bank letter

1040 = Individual Income tax return

1120 = Corporation Income tax return

If he has a corporation then he is NOT "self employed" because his corporation is also a "taxpayer" and he should be an employee of said corporation drawing earned income via a W-2

A self-employed person is someone who reports the results of there business as a part of the Individual Tax return (most likely on Schedule "C"). The person and the business are the same without a "legal" entity (corporation) in between.

The 1120 does you no good as the corporation is NOT your sponsor.

Tell your fiance to provide "complete tax returns including all schedules and supporting docuements". He'll know what that means. Alternatively, have him request the IRS fax him "tax transcripts". The affidavit of support it the US citizen's responsibility. It's so much easier to communicate with somebody who understands US tax returns. If your fiance doesn't then have him request the above from his accountant.

Ok last question, I promise :blush:

What is the difference between an IRS transcript and the official tax filing that my fiance has given me? Are they not the same thing?

My fiance has no supporting docs... he just takes his books to his accountant, his accnnt files his personal and bus taxes... there are no W2's... and he writes himself cheques through his biz account... he has documentation showing that he and his corp are one in the same?

Is there somewhere on the US Gov site that outlines what is acceptable for proof of income etc?

Thanks :) as i'm the one who does the 'homework' is there somewhere on the site where I can see what is acceptable supporting docs? My fiance is convinced that what we have is sufficient...i'm worried that it is not..

I did find instructions on the I-134, it states that if self employed,

they require:

A copy of your last income tax return filed, or

Report of commercial rating

I see that most people provide 3 previous years. And it does state that a legible copy of an original is acceptable. Am I looking at the right instructions? (this is off of the US Gov site)

If your fiancee is self employed he wouldnt have W-2 he would only have 1099's . That he gets issued from other bussinsses he does his own bussiness with . So no w-2 only 1099's he has , IRS Transcripts will be good and you can order them from http://www.irs.gov Information of his net worth for the whole year , and a copy of his tax stamp , and bussiness license . Will be very helpfull in the visa interview
