ITIN application (W-7 IRS form)

Yes, you can dowload that form...kindly check on www.irs.gov

As for the statement/declaration, you can just prepare it yourself containing details like:

a) one is a US Citizen then include identification no. (SSN, etc)

B) one is a non-resident alien then include identification no. (passport #, etc)

c) that both be treated as resident aliens for tax purposes

d) signatures (husband & wife)

Hope this info will be of great help ;)

By the way, we still have to file the forms next week....so this information is only based from our research (IRS and other forums from this site) :blush:

I used the W7 and filed jointly when my wife and daughter were still in the Philippines. No problems other than IRS didn't except my step daughters W7.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

My husband filed as married and is getting me a TIN. We filed it a month ago, however, we still don't have his ITR and my TIN yet. My interview will be on May 4, 2009 and we haven't submitted the AOS packet yet, because of this. Do you know the length of time that we have to wait till we get my husband's ITR and my TIN? He filed for my TIN because if he won't, he would be taxed more. Please help me. I'm really worried.

My husband filed as married and is getting me a TIN. We filed it a month ago, however, we still don't have his ITR and my TIN yet. My interview will be on May 4, 2009 and we haven't submitted the AOS packet yet, because of this. Do you know the length of time that we have to wait till we get my husband's ITR and my TIN? He filed for my TIN because if he won't, he would be taxed more. Please help me. I'm really worried.

For what I know, you can just have a copy or your petitioner's federal income tax return with the attachments such as W-7 (ITIN application), W-2s (withholding taxes on compensation), statement re: US Resident treatment for tax purposes & 2555-EZ for 2008 because the tax transcript and the ITIN cannot be processed right away.

Husband obviously has a foreign address since he never lived here, but I was wondering if under mailing address i should put my address here in the US, and put his address under foreign, so that all communication comes to me. arrrrrrrrgh those IRS agents are F-ing useless, what ever question you ask them they read something off of the information that you can see yourself online. I can read, I don't need you to repeat it to me lady, I am calling because it makes no sense to me, frickin' clarify it for me!!!!!!!!!

I am reading over the info that accompanies W-7 application, and it says that any visa information showing in the passport must be entered on line 6c.

My husband came to US only once in 2007 on a B1/B2 visa, which expired last year. He left before it expired, of course.

I called to ask whether I need to put that info onto W-7 even if it is expired because it is in his passport, or does that question pertain only to visas that are still currently valid.

The IRS lady did not know, she kept reading that script and at times sounded like yes I should enter it, but it was not clear at all... she was very mean.

I mean, it only asks for entry date to united states, nowhere does it ask for when he left US, so if I fill out the form like she is making it sound then it will sound like my husband entered US in July 2007, has not left, and expiration date on visa was August 2008.

I don't wanna cause confusion on that form to raise flags, but if it is important that I put the visa info, then I guess I should.

I am just so confused.

Dealing with immigration visas and taxes sucks, I am so ready to throw in the towel, I cannot deal with it any more, I am exhausted and no one can help when you call them, they just make you run in circles.

What should I write in on this damn W-7 application, should I just write NONE since his visa has long expired and he has not overstayed his visit, and just not think about it any more? I am so lost...

We were not able to apply for ITIN... Can we still ammend my husband's tax info since his status are still single.. Once i got my SSN - can we change his status to married and ammend it so that i can also receive some refund next year?

I wanted to leave an update here for another poor soul who goes through this process, so that you may know how long it takes ...

We sent in W-7 application and tax return on 28.May, and my husband just received his ITIN yesterday, 26.June.

Just waiting on our tax return to be accepted now ...

What we sent in:

W-7 that husband signed and mailed to me - not notarized or anything

Certified copy of his passport biographical page

A statement which we both signed and dated in which we have written that we would like for husband to be treated as US resident for tax purposes

We also declared in that letter that husband is currently a student, that he had no job in 2008 and therefore no foreign income to declare.

Marriage certificate

Tax return (1040)

w-2 forms for me
