Job change and move while I-751 case pending

Hi all -

We are moving from Philly to Boston due to job change this week. I had a 3 questions (sorry if they are already covered):

1. Change of Address forms to be filled???

- AR-11

- I-865

- Do I also have to call 1-800-375-5283 (customer service) to inform them of address change since my case is pending??

2. Will the NOA1 Extension Letter be sufficient proof document to show for I-9 form?

3. My 2-year GC expired on 13th March 2009. My NOA1 extending my GC status for 1 year is dated December 20th 2008. So, is my GC extended till 20th December 2009 or 13th March 2010?? i.e what is the year extension span based on?

I also did the USPS change of address to forward my mails from old address to new one...just in case USCIS takes time updating their Databases... :)

When we moved - it didn't take long to get a confirmation letter (that they were updating their records)... but USPS won't forward USCIS mail unfortunately... Assume the best and follow your status online until you at least get the confirmation letter.

Wish you good luck with move and Job. Hope all goes well for you. Now to your question.

1- I think since I-751 is filed by the immigrant and not the sponsor so i think only your change of address should be sufficient and since USC are not required to report USCIS for their change of address.

so use the following link to change your address online.

Paper based change of address and electronic are the same. The electronic version is better and more effective because it gives you a confirmation number,

plus it getter you new address into USCIS system quicker.

You can either print the confirmation page or save it as PDF for your record.

I think you don't need to call them if you change your address online, it will be quicker and will go in their records. Plus if you don't hear anything from USCIS after 6 months of filing send your 2008 Tax return and change of address receipt and other bills and documents of this year as additional evidence, so that it forces them to reopen your case or update it's status etc.

2- Based on my conversation with immigration officer regarding the NOA, he said that the employer should accept it as proof of work authorization as It's an official government document. If they have questions regarding it, they should call USCIS about it. I know the HR people like to have a card or stamp or something but i think for I-9 which is another government document the NOA should be sufficient.

Don't tell HR to call USCIS until unless they are really hesitant about accepting it.

3- It's normally 1 year added to the expiration of your GC so in your cases your GC expired on 13th March 2009. so the NOA has extended your GC till 13th March 2010.

I would call the 800# and give them your new address.

I would mail a copy of the AR-11 to VSC.

You don't want USCIS to mail things to your old address. From what I understand, changing you address online or through the mail while you case is pending does not update your mailing address on your case. That is why I am suggesting you mail a copy of the AR-11 to VSC along with a copy of your NOA and identification numbers.

Most employers shouldn't have any problem at all. It's just the way you present yourself matters. Devil is in the details, if you try to explain them that you only have letter and you have applied for removing of condition, and your employer doesn't understand, it can go against you.

So if you proceed with caution your employer should be fine.

Show them/HR your expired GC, State ID and tell them you applied for the renewal of card and it can take 6 months to 1 year. The immigration service has sent you an official document to extend your employment authorization for 1 year while your case is being processed which is equivalent to having a temporary physical card while the 10 year card is being processed. So rather than giving you a temporary 1 year GC they gave NOA letter which allows to you work and travel same as you did before or if you had a physical GC.

If they insist on further documents, tell them this is the document that you have and if your GC doesn't arrive in 1 year USCIS will stamp your passport and you can show it to them.

If things go out of hand, ask them to call the number given on NOA letter as when i asked these questions on a recent infopass appointment the officer should me that NOA is a government document just like GC is and the employer should comply with it.

In half the same boat, as we are going to be moving to Falls Church next month (we still are "in limbo" though at CSC rather than VSC due to transfer).

(I guess we still should be sending N-400 to VSC, despite of our I-751 being transferred to CSC?)

Please tell us your experience so that it helps others. Thanks Karin und Otto for correction. I didn't submit the change of address for the USC-Sponsor for my I-751 but still got the NOA and biometric letter. Is it necessary or if you don't do it does it cause any problem.

I just wanted to update everyone that my employer had no problems accepting NOA+expired GC as one of I-9 documents, although it was accepted as a List C document only. So, I had to show my DL for Photo ID.

Also, being really nervous before my first day, I was doing some web research and came across USCIS I-9 webpage where the new I-9 form (to be used from 3rd april) has been posted. Along with the new I-9, a new updated (IMO very thorough) Employer Handbook M-274 is also posted.

In the new M-274, have a look page no. 11 (or 9 if looking at page no. excluding title pages). The last row in the list of documents for Temporary Employment Authorization has "expired GC + I-797" as eligible List C document!!!! :thumbs::dance:

So, all you pending I-751 applicants, dont be afraid to use that flimsy piece of paper for work!!! :dance: :dance: :dance:

Oh and I did "change of address" online and there was a "touch" on my case the next day and I got an email from CRIS that they have updated my address on my pending application....I am still sending in a paper copy and will call customer service just to be a pain in their a##. :whistle:
