Survivor benefits & I-134

Hey all, my fiancée was widowed a few years before we met, and she has a daughter from her first marriage. She receives survivor benefits on behalf of her daughter every month.

Can these benefits be used on the I-134? I know they're paid to support her daughter (they're in her daughters name), but she has to show she can support the three of us, not just myself.

Anyone know if these benefits can be thrown into the mix? Or even how we'd go about finding out?

There is provision in the I-134 form to include income other than wages.

If it is paid to the mother, yes, just as court ordered child support would be listed. It would generally be considered in the same way, including the possible consideration of how long the benefit would continue. If it's going to run out next month, it's not worth as much as if it would go another ten years, for example.

As I recall Social Security Survivor Benefits last at least until age 21 if they remain in school but after age 18 they can be paid directly to the survivor. At least, that's how it worked way back when I received them.

It is my understanding that if the widow is the beneficairy of the petition (the foreign fiancee) her income cannot be used for the I-134a. It is not clear in your question if you are the petitioner or the beneficary.

The income of the beneficiary CAN be used for the I-864 for adjustment of status after marriage. Correct me if I am wrong, I am assuming you (the OP) are the USC petitioner.

If it is our daughters and will continue after marriage then you should be able to include it However the amount you get can not be used as it ends when you marry
