Such a pleasure to have my post hijacked by old time flamer's day at the rest home! While some valuable thoughts were passed, some people whom I can't imagine getting as far as they have exposed their egos without even addressing my core question, which is - doncha think this is cruel and unusual?

Yes, wisdom about the capriciousness of timing is truth.

Saying 'Beeyatch be cool. That's how it is, bro!' with stronger language is juvenile.

I hope this situation only lasts for a couple of days, because I wouldn't wish it on anybody.

I got my NOA1 for my K1 petition in mid-March. I'm one of the lucky 1100 who were recalled after getting NOA2s and interviews. People who applied 2 weeks EARLIER than I did don't have to comply with IMBRA, while dozens of people who applied weeks or months LATER at VSC have already been sent the new RFE. We have no cohesive answers, no official explanation.

Nice how-do-you-do at a crucial step in building a life together. Are we cursed? Do we deserve such a negative omen?

I'm not putting myself in front of anyone else, but I just want to know if you think that this is a new brand of cruel and unusual punishment, some Caesarian Ides Of March thing, fate or what??

I know what you mean. Its amazing the way my perspective has changed over the last 6 months. Before embarking on this long long long seperation, I brasenly believed that, no matter what if you love each other it will work.

Im starting to think its not that easy. It really takes strain. Then, throw a wrench into the gear works? Now its even harder.....wow. I cant take it for granted anymore that this relationship will take care of itself. It really needs to be maintained.

Although I dont think this is any kind of an F-U to any of us personally. I do believe this law was created for a good reason, its just that we are the unlucky shmucks who happened to be in the wrong place at the wrong time, to be the ones and only ones who actually already were knee deep in the process and were then asked to get to the back of the line again.

There is a finite number of us though. After all of us NOA1&NOA2, packet3, interview cancelled'ers are finally cleaned out of the system, all new applicants for this K1 visa in the future will be given the 129F right off the bat and wont have to worry about any of this mind numbing backpeddlling.

Hang in there. Muster the kind of strength inside of yourself that you have never had to muster. This may be the thing that you remember for the rest of your life. The biggest challenge. One day you will be proud and also in awe of yourself for having gotten through it.

Many of us may actually have to crawl or be dragged through that finish line. Old and grey and withered. But it will happen.

To answer the question: This is cruel and unusual because we are being punished for following the law.

You have every right to vent. If they want to enforce the f'ing law, do it, but what's this recall BS. Let them enforce the law when they have their damn forms up-to-date first. :ranting:

I for one am just getting started in this process, and I sympathize with you. I have not had the setback you had, so I can't compare my setback(s) with yours, but I just wanted to voice my support. Being in love with someone, and not being able to be with them is terrible... any way you look at it.

IMBRA was NOT created for a good reason. This law was intentionally designed to make it difficult for people to EVEN GET TO KNOW potential foreign spouses, under the guise of protecting women from potential abuse.

Interestingly enough, the law contains specific language that puts restraints on so-called "International Marriage Brokers", but SPECIFICALLY provides for the large USA based "International Marriage Brokers" such as Match.com... it helps to have a powerful lobby...

The number of women being abused due to international marriages is extremely minute compared to the domestic cases of abuse... but the media loves to focus on the senationalized international stories... the media also loves to lump in the concept of "human trafficking" with "foreign brides" to convince the public that they are one and the same...

If they really wanted to stop abuse, they would have put their "good intentions" into domestic prevention of abuse... if they really wanted a fair law, it would apply to the big domestic based companies like Match.com as well...

This law, like most laws that get media attention, is simply cleverly disguised gobbledygook, serving as a smokescreen for a handful of people with a hidden political/economic agenda.

Now ironcially, even people who met on Match.com International, may suffer the consequences of this law slowing up immigration... but what does Match.com care at this point, they already increased their market share by making it more difficult for NON-domestic companies to do business in the first place...

IMBRA is being challenged in court as we speak. Don't worry, that won't make your visa's take any longer. This law is overbearing and not of our constitution as it's written. Most of all it implies all men to be abusers and forces men to disclose all their personal information to a woman even before they can say one word to each other. A speedy receival to all of your visa's. Please let your representatives in Congress and Senate know how you feel about this law. It will help future VJ'ers.

I really don't understand why you think a "sponsor and supporter of IMBRA" could be sued for damages done by the law. Another point, damages done by the law itself have not been manifested yet, the only reason people are upset so far is the way the USCIS and other agencies have stalled and were unprepared on IMBRA's implementation. Ae you saying that all you want out of this is no change in the law and just a chunk of change? What about your fiancee? The law was passed by US legislators and they are the ones responsible for IMBRA's existence. I highly suggest getting involved with your congresspeople in order to understand and challenge the law in a more effective fashion if you are interested in that at all.
