Are you getting I-864 approved without 2008 tax return?

I'm wondering if those of you flying thru NVC are getting your interviews scheduled without submitting the 2008 Tax Returns? I haven't done my taxes for last year yet, and I am ready to send in the I-864. I have 2008 W-2 available.

We completed NVC a month ago today. We submitted tax transcripts for 2007, 2006, 2005 and copies of pay stubs for all of 2008. My husband did have his W2 but we did not submit it. We had our case completed in 3 days! Good luck.

I used the same years and paystubs and had my case completed as well without any issues. The question I now have is will I need my 2008 returns before I got to the interview since my wife's interview is after April 15th?? Any Ideas?

Just send your 2005-2007 tax returns, if you feel uncomfortable, just add a note stating you haven't filed your 2008 tax returns and send a copy of your 2008 W-2, but you don't have to submit your 2008 tax returns, in the packet it should ask for your most recent tax returns, technically they're not even asking for 2005 or 2006, just your most recent, but to be safe send as many tax returns as possible back up that you can support your dependent(s) financially.

you no need to worry about 2008 tax returns, because you already complete the NVC. after April 15th they will be asking for 2008 tax.

Here is the part of email which NVC sent us a month ago.

"You must provide either an IRS transcript or a photocopy from your own

records of your Federal individual for the most recent tax year(Before

April 15, 2009 = 2007 Taxes - After April 15, 2009 = 2008 taxes). If you

believe additional returns may help you to establish your ability to

maintain sufficient income, you may submit transcripts or photocopies of

your Federal individual income tax returns for the three most recent

years.

If the Internal Revenue Service (IRS) did not require the petitioner or

co-sponsor to file a Federal tax return for the requested tax year,

please provide the NVC with a written explanation and a copy of the

instructions from the IRS publication that shows the petitioner or

co-sponsor was not obligated to file. For information on most income tax

obligations, visit the IRS website."

You shouldn't need it because your I-864 was approved on the documents you provided but if you can send it for the interview better to be safe, a CO can ask for anything they want but i doubt it will be an issue especially if your other documents showed well above the poverty guidelines.
