Married in December...US taxes question

Hello -

I think I may be over thinking...

We were married in December and clearly my husband as no US income for 2008...

As it best to file as "married" and just use my income on my 2008 Income Tax form?

And he files as before in Canada for his Canadian 2008 income?

You both need to file "married" as you were married at the end of December. Canada and USA have a tax agreement. I worked in Montreal for a year so I a familiar with it and in thei area we have many cross-border workers who deal with this. You BOTH must calim all income, Canadian and USA. You are obligated to pay tax on all of it. However, any federal tax paid in Canada on Canadian income is credited against your US tax. Calculate which country it is better for you to pay tax (most likely USA but not necessarily) pay the tax to that country and credit it against the other. Don't forget Provincial tax which may not give you the same discount. The Province of Quebec and the State of Vermont have no such agreements, you get to pay tax to both. :)

You will basically fill out a form claiming the income and the tax due, and then another form exempting the tax on that income. It is the typical method of tax calculation which assumes all money belongs, first, to the government and you get to claim "credits or exemptions" to get some of "their" money back. Yeah, we still buy into this BS.

Another option may be "married filing separate" I have no experience with that as I was single at the tie in worked in Quebec.
