Questions about evidence

I have filled the I-175 and am working on gathering the evidence. Should I include our 2006 taxes even though I filed seperately though we were married. (Sam didn't file as he wasn't working in the US during 2006). Also, do personal letters have to accompany the sworn affidavits from the people signing them? I found some sample letters in the guide and wasn't sure if they were optional or not. I noticed on the sample cover sheet, it mentions that a passport is included as evidence but I don't remember reading that it should be. Have you guys generally included it anyway? And finally, I am submitting a copy of our joint taxes for 2007- do I have to include my W-2's as well as Sam's? This is not a transcript from the IRS but a copy of our filing online. I am confused. You said "I have filled the I-175" Do you mean the I-751? If so, did you not include the evidence with the I-751 and money? Why are you collecting evidence now? Please help me to understand. Thanks.

I meant that I had completed filling out the I-751 form and was gathering evidence to support it. I have not yet sent it in with the check. Sorry for the confusion.

Quick responses:

Affidavits are optional, if you choose to include them, they can be just a couple of paragraphs or they can be a long letter.

Passport is not a required evidence (I'm not sure what that would demonstrate...)

I would include all taxes that have Married (filing jointly or separately) on them

I would take the time to get the transcripts from the IRS - they are free, and you order them through the automated phone line.

It looks like you have to file 90 days before 6/19/09. You have time to get the IRS transcripts which can be ordered over the phone on their 800#. Also send copies of the state taxes - all forms.

We sent affidavits and pictures since our wedding. You can send copies of the personal letters also. Copies of passports are not necessary.

I suggest you read the instructions for the I-751 very closely and make a list of what they suggest. Don't forget the copy of the GC, front and back.

I would also suggest you search through VJ and find what others have submitted. Joint checking and savings accounts, lease/mortgage in both names, utilities & phone in both names, life, health, investments in both names. There will be things that you have not thought about. We searched and added a few more things.
