Hey y'all,

I have a few questions that I would like someone/everyone to try to answer, because it's hard to get a straight answer from my lawyer and I'm so frustrated I'm about to start crying.

1. After we get the NOA2 in the mail, does anyone have a check list for what exactly the petitioner needs to give the fiance abroad? So far I have this: Copy of the 1-129F package, originals of doc proof that we submitted with I-129F, original letter affirming desire to marry Janus once again, I-134 Affidavit of Support form, pay stubs, signed letter from my employer, copy of the NOA2, and proof of ongoing relationship. IS THERE ANYTHING I AM MISSING?

2. What is the Packet 3? My lawyer says he is the one who will receive this because he is our 'agent'; the Danish consulate website says we should have put my fiance as our 'agent' so we don't lose time for the packet to be sent abroad to the american 'agent' and then back overseas. It makes me upset my lawyer didn't tell us this from the beginning, because obviously time is valuable. And with all of this back and forth mailing overseas, this will be time lost.

3. Is the K-1 a non immigration visa or an immigrant visa? My lawyer keeps using both terms and I am really confused.

Let's start with #3 since that is the easiest... It is a NON-immigrant visa (technically) but with immigrant intent.

#2 Packet 3 is Embassy specific... but includes a list of things to do and get with instructions on where and when to send or bring. Including, Medical, Police report, Divorce info, court records, military records etc. As for who is the agent, if you are keeping up with things, it shouldn't matter much. You will know when you get your NOA2 and shortly after that, start calling the Embassy to get the file number for your case there... and you should be able to get things copied to you or your SO.

#1 I think you have it covered.

This attachment is packet 3 from Warsaw... it will be different for you, but it should more or less similar... so it doesn't really matter who gets it... as long as you have the data, you can get what you need to get back to the Embassy very quickly. In fact, I am going to get packet 3 pack to the Embassy before we actually receive it (if all goes well) and maybe even have the medical done... still trying to figure the medical out.

I have to ask, why did he go to the consulate in Denmark to apply for the tourist visa when usually Danes just have to get on the plane and not worry about a tourist visa? I ask because Janus is flying to America end of May to see me for one week. He came also end of March and was granted entry...

Go to one of the first pages of this thread and the whole story is there. Here is short version - Lars flew back and forth for almost 2 years using VWP and last October he was coming back and denied entry. He cannot use the Visa Waiver anymore and has to have a Visa to get into the U.S. now. It won't affect our application at all but it's damn inconvenient right now because he can't get back until we get the K1. We bought a house, establshed a life, sort of. Anyway, long story short, we were so stupid about things and had to learn and catch up and now we are almost through with this separation! YAY!!!

At the Embassy in Copenhagen they were very specific about when to do the medical and to NOT do it ahead of time. I know other countries will allow it, Denmark does not. Other than that, I think everything else is pretty much the same. I wanted Lars to go ahead and get it done now, so we'd be that much ahead of the game but they will not give him the list of approved physicians until Packet 3 and were very adamant about it.

Missy, what is 'too many times?' how do they define that.. and what difference does it make how many times? Sometimes I really don't understand why we do things...

They (the US Embassy in Warsaw) did not want to give my SO a tourist visa either after filing the 129f... but they gave her one! It wasn't easy, but they did.

Okay - "too many times" is all in the eyes of the Border Patrol Officer. In our case, he had been back and forth at least 6 times in 2008. 90 days here and then a few weeks back in CPH and then 90 days here....and so on. When he landed in JFK and he was taken to "the back room" they asked if they could look at his laptop, they found a resume with our Jackson address on it. They asked to see his wallet and his AAA card, library card, bank card, Kroger card.....all of the things that we have and never think about.....and they made the decision that he was trying to immigrate illegally and sent him home to get a visa.

My mother is dying and we aren't sure how long she will hang on and she had been asking how long before he's back, so....I asked him to see if he could get a tourist visa to come on back and see her. He went to the embassy and explained. They were very sympathetic but said they just do not issue tourist visas if a K visa is in process, period. He could have told them just about anything but opted for the truth. Now we just wait and hope it goes fast and he can make it back in time.

Sorry to give you too many details but....the back story sort of explains why we asked for the visa.

I had thought about going over this month to visit and going to the embassy and talking to them about the situation here but, I hate leaving the country right now and being so far away from everyone with all of this going on and I am going for the interview. I feel that we are so close to the end now and it was a tough decision but we decided to save the money and stick where we are right now and not do a lot of unnecessary travel.

Missy... I understand... I was kind of being rhetorical. I mean.. Yeah... Lars has intentions of immigrating after all that is ultimately what a K1 is all about. DOH, Mr. BP..... If he was going to do it illegally, would they have filed a K1? sheesh... I get very frustrated with government... Resume's, Library card... HELLO... its called preparation! :)

I am sorry about your Mom, can't blame you for not wanting to be too far away.

NOA2-August 6, 2009!!!

Im still trying to figure out if I need a co-sponser and my lawyer (surprise) isn't giving me a straight answer about that.

And does anyone know waht the I-134 requires as far as bank info and other assets? Looking at the I-134 form hasn't helped me.

That depends on your income and how many people in your household.

As for documentation - tax returns and W2 info definately. I have a copy of the deed to our house, a letter from our bank about when we established our joint account, how much we deposited in the last 12 months, a list of assets and of course the tax returns. Hope this helps. For most, if you are younger, you probably just need the tax stuff and if your income is belove the poverty guidelines you will need a co-sponsor.

Wow .. What has happen to VSC.

I thought by going to be with my honey for 10 days I would have seen some forward movment for all of us but its going the other way OMG ..

Has everyone gone on vacation? Sorry for the vent..

You are so lucky that you got to visit her!! I would give anything if I could go to Denmark right now.

It looks like my timeline moved forward a day, and another approval today, so that's good news. Maybe things are getting better now.
