I'm cooking up ideas for the honeymoon, after this giant mess people call immigration is over and we're finally together (horay!).

My question is, I know that during most of the parts of this process there are restrictions on where my wonderful fiancee can and can't be.

After we're married, are we allowed to leave the US for our honeymoon?

I have good ideas cooked up, but it might be nice to be able to leave the country too (we love to travel).

Hello,

Since you filed for a K-1, no you cannot leave the US after you are married. You need to apply for adjustment of status and advance parole, which takes about 90 days to be approved. Leaving without AP means your AOS case has been abandoned and will be unable to re-enter the US.

Perhaps you can plan a honeymoon in the US and plan for something more exotic at a later date!

Remember - it ain't over til it's over....and that means your hubby has a 10 yr green card in hand :) But really once you've started the AOS process after the wedding and he gets his Advanced parole and EAD....things are fairly straightforward since you'll be togetehr during any waits.

To answer your question - no, he cannot leave the US until he has advanced parole...which is after you've filed for the AOS. So unless you're postponing the honeymoon til then (which some have) .... you'll be within the US borders :)

Actually it's not over till he has his US citizenship as even Greencards can be taken away for numerous things, including living outside the US. Once he's a citizen then it's officially over...

GAH! it's a personal frustration that citizenship is assumed to be the end of the process....

There's a lot of us Canuckie couples whose goal is to move back to Canada eventually.. citizenship is not really the "end" of our journey. A 10 yr card would suit me just fine.. if it weren't for those darn USCIS fees for filing..

:lol: I personally can't get citizenship even if I wanted to or I would lose my duel status with Germany which I have had since birth. As I have family over there still it is important to me to keep that status, so I will be a PR forever unless we move back to Canada or I somehow don't care about my German status anymore.

It depends on when you want to take your honeymoon. As others have mentioned, because K1 is a single-entry 90-day visa, in order to leave and reenter the country, you need to wait for him to have either his green card or AP. It usually takes about 60 to 85 days after filing for AOS to get the AP, and of course you cannot file for AOS until you are legally married. If you want to go on your honeymoon right away, then you need to have one in the US. If you don't mind waiting, you can go anywhere you like.

There is always Hawaii!! As long as you don't have any stopovers in Canada or Mexico! I think there have been people who have taken cruises to Hawaii as well because USC do not need passports to go to Hawaii!

He didn't give the whole story. We're going to have a civil marriage not long after I enter the US (prob jan/feb 2010). Then we're having our Church wedding and reception in May and we're going on our honeymoon then.

My fiance is not so good at explaining sometimes.

My finacee's in the same position. We'll be moving to canada someday, but for now we're going to live in the US so she won't be getting her citizenship.

Just trying to figure out if we can leave the country after we're married.

As long as you have AP you can go anywhere you want. But without knowing for sure, I wouldn't plan anything big just in case.

That is more or less what we did, too. In our case, the date our venue was booked for turned out to be Day 87 after he entered. We did not know in advance whether we would have his AP by then, plus we had to travel for the wedding to begin with (since my father is not able to travel), so it was just easier to have the honeymoon in Seattle (90 miles from where our wedding was held) and wait for our anniversary to go overseas.

In your case, if you are able to enter the US and marry in January or EARLY February and apply for AOS immediately, you will most likely have your AP in time for an overseas honeymoon. The problem is, there are no guarantees of that with USCIS. I would say that your best option might be to plan on a mini-honeymoon closer to home right after your wedding and then book something bigger for later. If it turns out you are here and married sooner than you are estimating, then you might be able to plan an overseas honeymoon immediately after the wedding in May.

Why not delay the honeymoon until your first anniversary? I mean, you already get a big party in May, so hit a hotel or something for a couple nights afterwards so that you don't have to clean your house or cook and can relax, then go on an actual honeymoon as a first anniversary thing. Draw out the partying for maximum enjoyment. I've known a couple of couples who went on the honeymoon right after the wedding and were so exhausted from the wedding stuff and a flight right after that that they basically slept through the first couple of days of their honeymoon.

March 13, 2009--Visa application handed to the post office.

March 16, 2009--Visa application received by Vermont Service Centre at 11:01 am. Let's hope that he actually put in everything he thought he did and they don't send it back to us!!

March 23, 2009--Got the whole package back. The cheque was apparently filled out incorrectly, thanks to the fact that his moronic flatmates helped him and instructed him wrong for the first cheque he ever filled out.

March 30, 2009--NOA1

August 12, 2009--Touched

September 1, 2009, received Package 1 from Montreal--but where is our NOA2???

There are lots of great romantic and fun places to go in the US for a few days, so you could do a mini honeymoon. You have this figured out it seems though. :)

We are going to go to New Orleans to get married and spend a few days there. We had a great trip there last year and can't wait to go back!

  • 7/24/08 -- NOA1 (finally!)
  • 12/2/08 -- NOA2 (WOOT!!!!)
  • 12/8/08 -- received at NVC
  • 12/22/08 -- packet 3 (with packet 4 attachment instead of checklist :P)
  • 12/29/08 -- packet 3 sent back with bits and pieces that I pulled together to make up a packet 3
  • 1/5/09 -- actual packet 3 received, but found out by via e-mail that they were satisfied with what I had already provided
  • 2/10/09 -- found out via call to DoS that my interview is scheduled!
  • 3/16/09 -- interview!!!! APROVED!!!
  • 4/7/09 -- MOVE!!!!!!!!
    Crossed at Detroit/Windsor Tunnel... pretty painless, about 45 minutes, inexperienced officer, asked for and received EA stamp
  • 4/13/09 -- Married in New Orleans!!!!!!!!

  • 6/1/09 -- AOS etc received in Chicago

AP could take up to 3 months or so. We wanted to go away to get married, we are limited to Florida or Hawaii for a beach wedding :( and Hawaii... too much hype around it for the $$$ etc...

So Honeymoon may have to wait a few months after the wedding.... i'm sure you'll find things to do :devil:
