Co-Sponsor or not?

hi everyone, i am organizing the documents to sent to my fiance before the interview, but i have questions regarding I-134 and Co-sponsor. well here is my situation.....

i lived the past 2 years in Colombia with my fiance, I left the US in mid 2006 and came back in aug.2008, i didnt file taxes in 2007 because i was not in the US and didnt make any income. i just recently filed but it was only for 3 months of work (Oct - Dec) and was laid off. i obviously didnt make over the poverty limit because i was only emplyed for 3 months. i am no longer with the company. i am now an independent contractor making above the 125% poverty limit for 3 (k1,k2 and me). here are some of my questions....

1. Do i need a Co-Sponsor?

2. what should i send my Fiance?

Since i am making over the 125% poverty line, is it necessary for co-sponsor? the documents that i am planning on sending is a letter from employer stating that i have been working from feb.2009 til present and stating how much i make weekly probably. and pay stubs probably all the pay stubs since i started working again, is this enough? im not sure what my last tax return is going to do, i think its only going to confuse the CO, i cannot go to the interview and im afraid that my fiance is going to get confused with all the forms and everything.....would it be really necessary even though for my tax returns even though i lived in Colombia for the most of the last 3 years and didnt make close to the 125% poverty line.

if it is necessary necessary for a co-sponsor i was thinkiing about my dad, but he is as well an independent contractor but hasnt filed his taxes yet and wont file until summer (he always files for extention) he makes claimed about 80k+ a year but if he wont have a letter of employment that states at all what he makes because he is a truck driver and depends on the jobs he takes, it varies day to day. i dont think he will be a good co-sponsor because it wont have his earnings for 2008. should i find a different co-sponsor or are my earnings suffient alone?

interview will probably be next month, in april....dont know what i should do.....anyone have any advice as to what i should do?

A co-sponsor is probably a good idea. Rather than worry about anybody being confused, you could write a cover letter for the financial package to explain the situation.

A visa information specialist with the State Dept. told my son to write a letter and have it notarized, especially to explain why he was not required to file/pay taxes. He used that letter also to concisely explain his situation and to make his case as to why his wife would not become a public charge. There was also a sealed I-134 in the bottom of the file from Dad. We'll never know if they would have approved the visa without it or not.

You should check with the Embassy as each has it's own criteria as the I-134 is not a legally binding document... in NZ, for instance, they care little about it. You may find that they are ok with a written explanation of why you didn't file taxes and proof of your current employment. If not, then I would imagine they would recommend a co-sponsor for now.

thanks everyone for the responses, i feel more comfortable and secure with a co-sponsor but considering the co-sponor i stated, generally speaking would it be best to use him or get another co-sponsor who has filed their 2008 income taxes? i think in Colombia they look at this as an issue (I-134).

It will depend upon what the CO wants. I Co Sponsor would be suggested but,

Just had a couple in PI forum that only had proof of passing a test to become RN's in USA and they got approved and neither had work.

You can always file your taxes for prior years.

i can get his taxes from 2006 and 2007 but his latest taxes i wont have and i would think they are the most important because they will state how much he made this past year. my taxes are very poor, for 2006 was only for 5 months of work, 2007 none, 2008 only 3 months of work.....i am only going to send my 2008 income tax and accompany a cover letter stating my reason. i guess it would be best for me to find another co-sponsor, so what do i need from the co-sponsor?

1. I-134

2. employment letter

3. tax returns from last 3 years? (is this all that necessary?)

is there anything else? also just to add, my income is sufficient for her and daughter to migrate to the US, wont they look at my income and pay stubs as more important?

I gave you my suggestion... call the Embassy. ;) They are the only ones that can tell you what will be required of your fiance at the interview. Each one is very different in their requirements...especially when it comes to the I-134. Explain your situation and ask what will be required for proof that your fiance will not become a public charge once in the US.

Because you are an independant contractor you receive 1099's? I am self-employed and was asked to supply a letter from an on-going contract along with my 1099's (and schedule C's) to help support my income. I know you haven't filed but if you are going to use what you are making 'now' this may be an option for you.

Not all contractors receive 1099's. Some never receive anything for income earned.

I filed Self Employed and only had to supply my taxes from the prior year, and a letter of employment from my own company that a relative signed.

thanks for the responses. well i just started working as a independent contractor, i had a W-2 for the 3 months i working in 2008, but i just started a new job last month and will only be able to supply a letter of employment stating that i am employed by them as en independent contractor and will supply my pay stubs, nothing more, alone i am making sufficient money for us, above the 125% pverty, but a co-sponsor would probably be best to have because you never know what they are going to say at the interview....

does the co-sponsor need to make alot of money? what if he makes the same as me around 35k, and he has 1 dependent and a mortage, is that OK or not enough?

They just need to meet poverty level.

I wouldn't be surprised if you didn't need a Co-Sponsor, but have it as back up in case you need it....
