Ok, we've decided to get married. She lives in canada and I live in the states. We have looked at the process of her becoming a citizen if the U.S. and understand the process. We are thinking about just getting married. She will be here for a few months this summer. So we just get married and hire an attorney to take care of the rest. What consequences are involved by not going through the proper channels. I've been told she may not be allowed back into Canada for a set amount of time. Has anyone done it this way, and if so, what took place. I'd be interested in hearing from you.

From what i understood, not only is she not allowed to go back to Canada for a certain period of time, but if they found out she enters US with the intention to get married, she will be banned for entering US for a looooooong time.

You say you know the process but yet you want to consider not going through "proper" channels... If you circumvent US immigration law and it is determined so, it will result in deportation of the alien and a lifetime ban to re-entry... a huge price to pay

Yes, be very careful. You need to take sometime and read through some of the forums on here. You don't want to do anything that could prevent the both of you from being together. We didn't want to take any chances so we are going the K-1 Route. We applied back in September and are now just awaitng our interview date. Which really isn't bad. We've been visiting back and forth while we await the visa. We figured it wasn't a really long wait to do things through the proper channels. This website is a great help! Good luck.

More than likely we'll go through the proper steps. We have all the paper work ready to fill out. We are waiting for her to come here in a couple of weeks so that we can fill it out together. We both know people that have gone the route I suggested in my earlier post and it turned out alright for them. I think it probably cost more than it had to tho. We don't want anything to interfer with this and that led to my post. I wanted to get some feed back. So far it has all been helpful.

If she enters the U.S with the intent to marry that one thing, now with the intent to marry and to adjust status that is fraud. It's all about intentions when you cross the border into the U.S. If you have intentions to marry and then for her to stay in the U.S and adjust status, that is a no-no. Please look into either the K-3 or CR1 visa and she would need to return to Canada after the two of you marry. If you are flexible about when you want to marry then apply for the K-1 fiance visa and she will be able to come to the U.S, marry and then adjust status. It's all about your priorities, as K-1 and K-3 you cannot work after entry into the U.S, CR-1 you can because you will receive a greencard shortly after you enter. Take a look at the guides on VJ as many people have not gone through an attorney and its pretty self-explanatory. Alot of people have had problems when they hired an attorney and it was a waste of money and time.

Are you planning to AOS from the U.S or go the K-3 or CR-1 and have her return to Canada?
