Financial Requirements for Co Sponsor???

How long is the co sponsor responsible for the endorsed person? Is it 3 years? Is responsibility continued after marriage or does it go solely towards the spouse?

In the K1 process there are 2 affidavits of support. The i-134 is just for the K-1 visa process. It expires when you get married and adjust status. When your fiance, then wife, adjusts status there is the i-864. The 864 is approximately a 10 year commitment. Read the forms for the details.

The support is only if the immigrant become a public charge. Then the sponsor would be pursued by the gov't for the expenses.

You aren't specific which affadavit for what. The I-134 is effective until it is replaced by the I-864 during adjustment of status. The I-864 is valid for 10 years or until the sponsored immigrant becomes a citizen or gets divorced and leaves the country. If they just get divorced, and DON'T leave the country, the sponsor is still liable EVEN if the sponsored immigrant gets re-married.

Exactly correct.

And if you are pursued like, say, Osama Bin Laden....no problem. But if you are pursued like you owe $83.74 to the IRS.......LOOK OUT!!!!!!!!!

The I-134 is hardly effective at all... it has been a document that is not been legally enforced

In addition to the above the only other terminating events are death (either the sponsor or the alien) and to clarify what was said previously, it is NOT just 10 years but 40 quarters of qualifying work credited to the alien (could be a lot longer that just 10 years).

So the best thing to do, is have your wife/husband become a U.S. Citizen asap.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

A K-1 can only be petitioned for by a USC... so presumably that is not an issue...

It is possible if the Alien works for 5 years (20 quarters) and is credited another 20 quarters from the USC in order to meet the 40 quarter credit requirement, but it will never be less that 5 years.

I am applying for the I-134 and may be using my mother as a co-sponsor due to current financial circumstances. My mother wants to be clear on how long she would be legally responsible for my fiance. From what others have posted here I assume it is until marriage? Afterwards when I apply for adjustment of status and the I-864 can I apply solely by myself? Assuming that I should be financially sound at that future time.

If you meet the financial requirements when filing for AOS then yes, you can sponsor your husband yourself.

As payxibka stated above, The I-134 is not binding on the sponsor(s).

*Update*

I contacted NVC by phone and they say the same thing that was posted here. That I-134 is for the 90 day k1 process and the I-864 is for approx. 10 yrs.
