Timeline

Well is actually my sister she is a US citizen her boyfriend was catched and realeased 6 times ( I know stubborn huh) ok so he finally made to the us 5 years ago now they want to get marry and legalize him. Now is it better to do all the process here or I dont know someone mention this to her but we think its risky but give me your honest opinion. Should he just go to mexico and pretend they met in MX she goes a lot to tijuana a lot so they can say they met there or something so thats something that someone told l her would be easier. He has never had a problem with the police or anything the only thing is he once got a traffic ticket and told the court that he would do community service but he never did it because he was very sick at that time and he got his car towed;however the car was not under his name. other than that he is clear. What would you guys suggest is the best way to do this. and what is the approx. waiting time on CDJ if they want to do the process like they should.

ok, First.... 6 times??? WOW. How did he manage that? Did he get deported all of those times???

Second... I wouldn't lie about anything. If you get caught lying it will be big problems???

Timeline

1. She first needs to make sure that all six times were 'catch and releases' because if even one turns out to be a deportation he will not be eligible to legalize.

2. He needs to first work on getting the ticket fixed and doing the community service. . .you really cannot do anything with pending cases against you. . .

3. File I-130 and indicate consular processing for CDJ because he's not eligible for AOS from within the US because of the EWI. . .do not try lying on the paperwork, that incurs a permanent ban for Misrepresentation (INA 212 6c)

4. At the interview he will be denied and asked to file a waiver (I-601 Hardship waiver) for the illegal presence and possibly for the ticket (depending on what the ticket was for). . .

5. Waiver interview: Same day adjudication, takes less than a week to get visa if deemed obviously approveable, but more than a year if it gets backlogged.

You will want to have her visit www.i2us.net for more information, there are a ton of people going through CDJ right now and they will help her out.
