Timeline
Were you married less than two years when you received the card?

When you were interviewed in relationship to your wedding date is irrelevant.

It's how long you have been married when they issue the card.

Ah yes, good point. Maybe it wasn't a mistake at all.

She did say she'd been married for less than a year when she received the card, no?

She said she was married 8 months at the time of the interview. Some wait many months after interview before the card is actually issued.

only 9 months when gc was received.

come on guys..do u think i have to file i-90.. theres no date on it or saying i have to ..it just states to correct classification. i thought maybe this was a generic letter or something with the top addressed in. also this letter come from the central director of vsc. so im thinking this letter is proof enough and his word is just as good as info pass. i need input.

me and my husband was planning a trip soon and i dont think im going to fool with the i-90 just yet if i dont have to.

Here is what I would do for pease of mind, schedule an info pass appointment to your field office, and bring everything that you have, the marriage cert, welcome letter, green-card, the returned I-751 package, and talk to an immigrations officer.

It is a mistake and a mistake made by USCIS is not a bonus. USCIS might correct their error at no charge to the alien, when they become aware of it, but it is still an error and the alien is not eligible for a 10 year card at this time. Ignorance of the law is no defense. You should consult either with an attorney to correct this.

Next up will be N-400 at three years of residency, if you wish to become a US citizen.

Their mistake is your bonus. I would hold on to that letter in case something comes up in the future.

Hi, I know a couple of persons who got married outside US. When they came here and got the interview approved. They had the 10 years green card instead of the 2 years green card. All of them aplly for citizen just fine.

There have been a number of us with the same situation as you. We also have this letter. You are good to go. I've done the calling, infopass, and I-751 and the result is always the same. Hold on to that letter. It is the best proof you can get. You do not need to do an I-90.
