Will my K1 visa be denied???

Hello everyone,

I am sorry to bother you with this but I am worried about one thing. I was married to a Philippine woman I wont go into details why I divorced her. She never has been in the states also. The point is I filed for a divorce and my lawyer did not pay attention to my county in Texas and filed in another county than I live. He told me it would be fine since they do not have rights over anything in the Philippines and I did not own anything while we were married.

Now what I am really worried about is that mess up on the county that I was divorced will cause my petition for my fiance's K1 visa to be denied. If there would be an issue what can I do to remidy this. I am in Iraq supporting the military so I can not go back to the states for at least six months.

I hope I am worrying for nothing.

And again I am only asking if anyone knows whether this will cause my fiance's visa to be denied!!

Do the I-130 - embassies hate K visas and deny them all the time. Plus you have to adjust status once your Applicant gets to the USA on a temp visa and that can be denied too - plus it costs about a grand extra.the I-130 may be a bit slower but there's a green card at the end of the rainbow and no adjustment of status.

To answer the question, if the divorce is legal by Texas law, then the USCIS will accept that you are divorced and free to remarry. No problem.

What ARE you on about. Embassies dont "hate K's and deny them all teh time". They deny ANY visa if a person doesn't meet the requirements and approve visas if the person does. It's that simple. If you live in a high fraud country, you will need more evidence of a relationship, but same thing for a CR-1. Obviously CR-1 has benefits over K3, but K1's also have benefits over CR1. Its an individual choice, please be more informed. Besides, if you go CR-1 and have been married less than 2 years (which they would be), then you will still have to file to remove conditions, which can be denied.

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08

This information is inaccurate and does not answer the OP's question.

To the OP... nobody can tell you if your divorce issue will cause a problem at interview because it's impossible to know without more details. But I do know that normally if a divorce petition is filed in the wrong county, the respondent must file a motion to transfer venue before filing any other legal pleading. This may be State dependant tho. I would call the County office and ask before filing, though.

If you are not both legally free to marry when you file the I-129f you will have wasted time and money.
