Conditional resident status: How do they determine?

Hi folks

My understanding suggests that a person is granted unconditional resident card (valid for 10 yrs) if he/she became a permanent resident 2 years after his/her marriage to a US citizen. so When does a person becomes permanent resident? on date of approval of immigration visa or the date he enters into the united states?

In my case, when my CR-1 visa was approved our marriage was 1 yr and 7 months old. When I entered the united states our marriage was 2 years and one week old. However, the green card that I have been issued is a conditional green card. So the question is:

Is this a clerical mistake? or

they determine the conditional status based on date of CR1 visa approval and not on the date of entry?

It is based on date of entry. You qualified for an unconditional status, but since the visa was CR1, you should have pointed out to the CBP officer that the marriage was over 2 years and requested unconditional residency.

You can make an InfoPass appointment and meet with an Immigration Officer, at your local office. They should be able to help you convert to the unconditional resident card.

thanks for confirming my understanding. I believe then I should file I-90 for replacement of conditional green card with an unconditional green card. I am going to have to send my original green card in order to apply for replacement. How do I get a temporary evidence of residence while I will not have possession of my green card?

No, you must send it with I-90. Don't forget to make copy of your Greencard.
