Trying to figure out I-864, household, child support, and poverty income?

Bare with me as I am new at posting. VJ has been very helpful but I hit a snag and i am so confused. My husband who is the sponsor received NOA2. I live in Canada and excited to get the noa2. (yay!) But, I am the Organized one of the relationship and have been carefully figuring things out from the beginning so I can explain it to my husband w/o confusing him. Just trying to prepare the documents so everything flows smoothly. I hope someone can help me with these questions based on Affidavit of Support Form.

1. My husband is paying child support (child lives with mom). On Part 5, #21.d, does he fill the box for "if you have dependent children, enter the number here"?

2. If he fills out Part 5 #21.d, does that mean on Part 6, #24.b, he has to add him on the list?

3. If I am correct with the 2 above questions, does that mean his poverty income is for household of 3?

4. and i know i've seen it in other posts, but while I am on this topic, i just want to confirm that the income is based on "gross"?

Thank you both. For the longest time I thought the incomes were based on net until i read some more posting. I was getting worried as the 2009 Poverty Guideline came out and incomes increased.

Another question, its an easy one.

Does it matter if my husband gets the I-864 notorized at the bank? or does he have to go to a notary or an attorney?

I'm from Canada so I never knew the bank can certify documents b/c we do not do that here. Apparently you can in US. He is from Washington State.

I do not see in the instructions that it needs to be notorized.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

The instructions are definite.

You, of course, can get it notorized, to make it look "more" official, but it is not needed as per the instructions.

The signature of the sponsor is the only thing binding on that form (or the preparer if used).

It used to be that some forms were to be notorized, but they dropped that requirement.

You may want to check with the consulate/embassy handling your case what they require, as they follow their own rules sometimes.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Since the new version came out three years ago, you definitely do not notarize the I-864.

If you pay online you would get a statement to send. I sent a check with the I-485, and sent it certified mail, I prefer to get all the evidence I can that they received it.

Another question. My husband was not working 3 years ago. Do I really need to send 3 previous tax returns? He only has the last 2 years. I know it says "send the most 3 years if we benefit from it" and on Part 25 on I-864, there are underlines to fill out the income for the last 3 years. So i just dont want to make a mistake and prolong the process. Can anyone give me an answer?
