question about criminal history

On the I-751, it asks if you have ever been arrested, etc. If so, you must submit court records. Am I correct in assuming this means EVER in your life, not just since you have been in the US?

My husband came to the US on a K-1 visa. He had a DUI in Canada in the 80's. With the K-1 petition, we submitted the court records. Do I have to submit those same records for the I-751?

I would submit them again. The instructions say to submit them. Good luck.

Thanks E :) We are just kicking ourselves that we didn't get an extra certified copy of those dang records. We have a copy, just not the official one. Poor hubby is mad at himself for this extra hassle of having to get those records again for something he did when he was 19!!! (He is 45 now ) :lol:

Yes, they ask for an original or court certified copy. I have turned in photocopies up until now but had to turn in the original with the I-751. Then, I had to order another original because the N400 also wants an original. You think they could check their own files once in a while!

Hi Autumnchik,

What a surprise it is to see you here on the I-751 VJ boards (in addition to the Canada boards that you're usually on)! Welcome! In answer to your questions:

-It used to be for just the USA only...but...they changed that when they increased the fees a few years ago, so now it does include all records ever regardless of country and/or timeframe.

-The records have to be "an original or court certified copy", as stated in the instructions on the

I-751 application forms.

Sorry that your husband had a Canadian record a long time ago before, and have to have that "catch up with him now" for US immigration purposes. I agree, you would think that they would have these orignal records before, and just look them up. I guess not then, as they want to make it even more "difficult" for those who have had records before. In your case, since you need it for the I-751 and for the N-400, then you should get several extra certified copies of them now, so that you can use them for now and for later too (lol..and in case some incompentent worker loses your paperwork). Also note that since you are getting records from Canada, make sure that you can get them properly paid for (I assume that the courts will charge a Canadian fee for these certified records) and make sure you get them shipped over here to the USA in time for you to have the paperwork ready for when you file the I-751 soon.
