Hi Trailmix...

Do I need fingerprints? I found a place for RCMP police records that aren't finger print based... you go in, give them your information and they do a canada-wide search and you get a read-out of that. I have no criminal past so, do I need a finger print based police record?

I won't get it done yet, but I'm just wondering in advance.

How far in advance can you get the police record? We are still waiting for our NOA2, but I'm wondering if he could go ahead and get this done now, since it doesn't seem to be quick process?

The police certificate is good for a year - the name check version is pretty quick - it's the fingerprint version that takes time. If he has no criminal record and he lives in Canada, the Canada wide name check will suffice.

NVC

July 8, 2009 to August 10, 2009 - 28 days

Interview Assigned - December 3, 2009 - FINALLY!!

Medical - December 14, 2009 - Passed

Embassy/Interview - January 26, 2010 Montreal, Quebec Canada - 167 days PASSED!!!

Port of Entry - February 26, 2010 Baltimore International, Maryland

USCIS -- ROC package sent off

November 26, 2011 to Vermont station November 30, 2011 received NOA1December 16, 2011 received biometrics appointment.

January 04, 2012 Biometrics

September 2, 2012, RFE Received.

September 22, 2012 RFE responded to

October 15, 2012 ROC approved, 10 Green card on its way.

No criminal record - then just the Canada Wide Name Check will suffice :thumbs:

Police Records

Inside Canada: Applicants who are physically present in Canada should contact their local police service or Royal Canadian Mounted Police (RCMP) office regarding criminal record check procedures. Applicants may obtain a certificate of no conviction issued by any Canadian police service so long as it notes that Canadian Police Information Centre (CPIC) or the national criminal records repository was searched using the applicant’s name and date of birth. Applicants should ensure that the search includes all names that they have previously used, including maiden names, prior married names, or names used before Canadian naturalization. (Note: Because records checks based on name and date of birth only are sometimes less thorough than those based on fingerprints, U.S. diplomatic offices reserve the right to request that certain applicants obtain fingerprint-based searches from the RCMP.)

Applicants who have been convicted of a crime in Canada must contact their local RCMP office to obtain a “Certified Criminal Record Check,” which lists an applicant’s criminal history, indicating the section of the Canadian Criminal Code under which the applicant was charged, the disposition of the case, and the penalty imposed, if any. Obtaining a Certified Criminal Records Check requires submission of a fingerprint chart; the RCMP could take between two and twelve months to process a request for a Certified Criminal Record Check. (Note: If a namecheck by a police agency reveals a conviction record, that agency may be unwilling to issue a certificate and may refer the applicant to the RCMP for a Certified Criminal Record Check.)

hello,

Just to clarify I understand this process....

my husband lived in canada for approx a year and half. He currently resides in Pakistan. NVC now asks for his police clearance certificate from Canada. Which is taking about 4 months. So what i understand is, he can get a name based clearance in 2 weeks? Is that correct? and if so...how? Who to contact, cause RCMP takes 4 months no matter what.

Kindly help out.

Unfortunately it doesn't look like that will be possible if he's outside of Canada right now.

Outside Canada: Applicants who are not physically present in Canada must obtain a Certified Criminal Record Check by sending a duplicate set of fingerprints (taken by a local police force) to the RCMP. Fingerprint submissions must include the following:

* rolled and flat impressions of all ten fingers taken with black ink (may use a standard FD-258 FBI fingerprint card)

* full name, date of birth, and sex of the applicant

* the name and address of the police agency taking the fingerprints

* the signature of the official taking the fingerprints

* the reason for the fingerprint submission (U.S. visa)

* the processing fee of CAD 25.00 or USD 18.00, payable to the "Receiver General for Canada" by certified check or money order.

Fingerprint submissions should be sent to: RCMP, Civil Fingerprint Screening Services, P.O. Box 8885, Ottawa, ON, K1G 3M8.

He can only get the name certificate if he is currently living in Canada. Former residents must get the fingerprint check unfortunately.

I have a possibly silly question about the Police Certificate. I just got mine last week and I'm mailing it out to my husband today. The certificate itself only lists my married name. However, they did check my maiden name as well, and I have a copy of the application for the certificate which shows that they checked my maiden name. It is signed and sealed by the issuing agency. I intend to include it as proof that they checked both my names. Is this the correct thing to do? Or was I supposed to get a second certificate with just my maiden name on it?

I'd probaby send both (it can't hurt). Mine listed both names - but to show both were checked you might as well send both. Better than getting an RFE and them asking forproof later which will only slow things down.

I do not want to disuade anyone from getting the fingernprint check if they are outside Canada. My understanding is that the requirement for a fingerprint check does not have to do with living outside Canada, but applying for the check from outside Canada. My husband can fly there anytime and get a fingerprint check as long as he is present in Canada.

The police certificate we received from COmmissionaires is a regular police certificate from CPIC check-name-based. It is issued from RCMP authorized office 16 and signed by the police Chief in Charlottetown. It is a certificate for employment, visa, and foreigntravel/work. As far as I know it is the same certificate we would get if he arrived in Canada and requested a name check.

Our application was submitted last week. I wil let everyone know when we hear anything.

I think you meant to say he can fly there anytime and get a name check as long as he is in Canada?

Yes, please keep us informed as to whether or not this flies at NVC and at the consulate interview.

I agree with you that the way it reads is that anyone should be able to get just a name check (as long as there is no criminal record). It is possible that the NVC (dept of state) does not understand that the CPIC name check is available when you are not physically in Canada.

I dunno. I was specifically told in Bermuda that it had to be a fingerprints based police certificate from Canada. She was very, very clear that nothing else would be acceptable. She also told me that the normal names based check was enough for Bermuda.

You never know though. It seems that all the different embassies/consulates don't always play by the same rulebook. It's probably best to always call and find out exactly what they want.

Ok, NVC sent an RFE quoting the Canadian rule that my husband has to get a fingerprint based check. So, now I am wondering about all the people I read who live outside Canada and had gone to Canada and gotten a name=based check. Were their's accepted? I have emailed NVC to request a response about whether it is acceptable for him to fly to Canada/ the Canadian site just says "present" not "residing" in Canada. We have submitted for fingerprint based certificate. Usually COmmissionaires could do this quicker, but their machine has to be inspected and could take months. we got an extra set of prints just in case they get up and running again.

I'm still determined to move this process along......the separation is getting old.

the contracted agencies do process the certificate much quicker than the RCMP itself. however they do charge more.

and RCMP does take a while to process them and 150 sounds about right.

hope your certificate is processed in time.

we contacted RCMP directly as I was in a rush and did not know about the agencies till much later.

although I somehow managed to have it expedited and processed within a month.
