2009 taxes won't be filed until 2010 but if you mean 2008 it can be a toss up.

Hi,

I have an interview on 3/31. Do I need to file taxes before the interview and bring the proof of filing for 2009 tax or it will not be required?

Please, advise. Thanks

Vital

Do you have previous years IRS transcript, e.g. 2005, 2006, 2007? It yes, then it'll be fine. I think you could bring the W2s if you didn't have enough time to file for 2008. Even if you file now it's really hard to say if the IRS is able to provide you the 2008 transcript right away. But it's better to file it to bring the copy of what you filed and the W2s to cover your butt and say look, I've tried, not my fault that IRS is slow to provide the transcript. That way they'll have no excuse to say "decision can't be made until further evidence is submitted" which is the 2008 transcript. I think other people faced the same thing and USCIS has that kind of situations every year for everybody. No one can say for sure what the USCIS guideline is, I guess it depends on the IO.

Please do come back and let us know your interview experience.

I have my interview on March 17th and unfortunately I wasn't able to get an appointment to file my taxes until the 12th. I'm planning on taking my copy of my tax return to the interview plus the tax transcripts from the IRS for the years before. I would hope that this is enough. I mean, taxes for 2008 aren't even due until April 15th. And sometimes you have to wait for paperwork from your employer, banks, child care services and so on, so you can't file taxes right away (we just got all the papers about two or three weeks ago).

Stelle,

I have applied for tax transcript on Jan 27th and I haven't got it. I don't know how long I have to wait. I am worried maybe I put something wrong on my application.

Technically they all need to provide you tax statements (W-2s. 1099s etc. etc.) by January 31st - otherwise they might be in violation of IRS. Yes, some partnerships and investment providers can take longer - but no way a W-2 or Mortgage/interest statement etc. can be delayed legally beyond Jan 31st - they must mail it by then.

You can do your taxes in two or three hours by sitting on your pc and using a turbotax or taxcut or other such website or buying a cd and doing it. If you have some understanding of numbers and forms - you should be able to do it - no need to pay anyone to do your taxes unless you have extreme complicated financial/tax situation. You can take a copy of your taxes to the interview (or mail it with your N400) tax transcripts are not a must (I have never used transcripts - just the copies from my internet filings). Good Luck

I did my taxes online using TurboTax as soon as I got all my documents (W2's, 1098s etc) and called and submitted a request from the IRS for a transcript as soon as they had deposited my refund into my account.

I'm hopefull I'll get my transcript from 2008 in time - but if not I already have copies of the transcripts for 2005,2006,2007 and have a printed copy of my electronically transmitted return, along with my W2 and 1098, and a copy of the bank statement showing the amount of the refund shown on my return being direct deposited into my account by the IRS.

I figure with all of this I have more than enough if, by some fluke, the transcripts for 2008 do not arrive on time - and can simply explain that I did not get the transcripts yet.

Regards,

Jamie
