Anybody here got a 212a(5)(A) Refusal on their K1

One of my friend's fiance had his interview yesterday and the consulate wrote on the paper, the doesn't beleive their relationship is geniune beside all the evidence and poof submitted.

The consulate asked him only 1 question, how did they meet and that was it, He told them the truth they met at a party at a friend's house.

So she wrote a letter to the consulate and that was their replies.

Dear Ms. Y.

Thank you for your inquiry regarding the fiancé visa petition filed on behalf of Mr. X.

During the interview, Mr. X failed to submit strong evidence demonstrating that the relationship was entered into for reasons other than to acquire immigration benefits. The consular officer was not convinced that Mr. X and you have a qualifying fiancé relationship. The beneficiary was refused under section 212a(5)(A) of the Immigration and Nationality Act (INA) and the petition will be returned to USCIS. If you would like to pursue this case, you will have to contact the USCIS District Office where the petition was originally accepted.

We regret that we cannot offer a more favorable reply to your inquiry.

Sure sounds like they didn't have much evidence of a bona fide relationship. Must have been awile ago if one of the wrote a letter nd got a answer already!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

You usually do not get documents back. Anything sent to them becomes "their" property most of the times.

Copies.

Unless specifically required that an original document be filed with an application or petition, an ordinary legible photocopy may be submitted. Original documents submitted when not required will remain a part of the record, even if the submission was not required.

You can request them, but they can keep them, so it's up to them if they will give them back.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

This code tends to result in a default finding of misrepresentation resulting in a permanent ban from the USA. I this is a genuine relationship, then all efforts to overcome the initial denial are critical.

It depends on what original documents you are referring to. My fiance received all of our relationship proof we submitted including phone records, cards, emails, letters, and our photos along with his passport. He was denied in Delhi, and our documents were returned via the VFS office.

He is home!!!

Ooopppssss the same for my K-3 application denial, they sent back the petition to USCIS and the CO advice is any question will be address directly to USCIS, tell your firend to write a letter of appeal direct to NVC as soon as possible:

here is the email address: NVCInquiry@state.gov ( if you want you can try this letter format i hope i could help) she need to provide more proof for there genuine relationship that's the documents that they ask from me for my last interview and got approved, Good Luck for Her....

Same here, denied on the same day with letter" you are engaging in a sham divorce for immigration benefits. Your case will be returned to the Department homeland Security".

l was sapareded with my ex in 2 years but not divorce yet, then meet my fiancee ( husband now) and done for divorce paper work. They asked me to write it down, l did but they still denied.

Now we live out of USA 4 years already.

I'm ok, but my husband miss our family there.

We don't know what to do next???

It was kinda the weirdest interview,

Basic questions

how did you guys meet, what work does his fiancee do in the states, they had sent photocopies of his sons birth certificates, they requested to see the original. He mentioned some of the interviewers were very rude to other folks going for their visas, but he had a nice interview and the guy was very gentleman and very professional.

The CO came back a few minutes later and gave him this form saying his purpose for this immigration is for Visa purpose only not Love/Marriage.

Weird they didn't ask him to bring futher documentation, and they kept the original birth certificates of the kids that they had asked to bring at the interview, now the main Question is how to get those documents back.

The CO doesn't even said anything as to why he came up with that decision, they had lots of chats, visit, and the MAIN PROBLEM is the unknown factor WHY

Without the WHY, He had no chance to even explain what kind of misunderstanding, or confusion that brought them to this devastated decision.

Why do you think they rejected it?

Absolutely no clues were giving, on a email to the Consulate they mentioned they had sent the case back to USCIS and that a note explaining their decision, but why not just say what's on the note, nobody knows
