Hello,

My name is Ovi and I am having a terrible time getting my Oath Ceremony rescheduled. I had to move from Chicago to Dallas and because of it my oath ceremony is now delayed 6 months. It has been almost 7 months since my intervew in Chicago. I have done a service request and wrote to the senator here in Texas but no good news yet.

My question is this. I have a letter saying that my N400 application was approved and that they are just waiting on scheduling the oath ceremony. I am engaged to a wonderful girl in Romania and I was wondering if there was any way to start her paperwork for the K1 visa with the N400 approved and without the Certificate of Naturalization. Is there anything I can do??

Timeline:

K-1 Visa

04/09/09 : I-129F Sent to Vermont

04/10/09 : I-129F Received by USCIS

04/14/09 : NOA1

08/19/09 : NOA2

08/24/09 : NVC Received

08/25/09 : NVC Left

08/27/09 : Consulate received

08/28/09 : Packet 3

08/31/09 : Packet 3 sent

09/16/09 : Interview - Approved

09/21/09 : Trip to Dallas

I don't think so.

Intil you have the certificate of naturalization in your hands, you are NOT US citizen, yet.

But one thing you can do is to schedule InfoPass appointment with your new USCIS DO in the area.

If it is more than 120 days since you moved in, you can request the case update in person, and ask for expedite processing.

If you feel you need more than that, you can try to use court system called Mandamus action.

With a couple of my wife's friends having similar problems with the Chicago office glad we are not dealing with them. To complicate matters, certainly a degree of question with the integrity of Illinois politicians. So one question, did Chicago ever forward your application to Dallas? Can say this, if you don't do anything, nothing will happen. We had problems with St. Paul with the oath ceremony, and writing e-mails or letters can be worthless. So personally visited my senators office so they can see we are real people. Could try that.

No. You'll need to provide evidence of your citizenship for the petition.

I though you could apply as a LPR, but will just take years instead of months, correct me if I am mistaken.

For the I-129F you must be a citizen....

Unfortunatly reschedualing the Oath thows you back into the system where it's very easy to get lost or delayed for quite sometime. Some over a year or more. This is why they say never try and postpone it unless absolute nesscesary.

Not sure what you can do other then wait and wait. Might try and make an INFOPass appointment or something?

Oct - Filed N-400 for Naturalization

Nov - Biometrics done

Nov - Just recieved Naturalization Interview date for Jan.

Jan - Naturalization Interview Completed

Feb - Oath Ceremony

Feb 21 - Finally a US CITIZEN (yay)
