need info

what agency enforces court ordered child support in the philippines? both parents live in the philippines....

All I know is that you go to court and file a petition for support against a person who refuses to give support to his child or relative.

It is a matter of the court so never mind what agency - because you'll likely need a lawyer to handle the case for you anyway. Matters such as these would probably be rather tricky in the RP given all the corruption at every level.

Strange situation, however. If the parents are well off, I can't see them not taking care of their own child (could hire a maid to do it). If the parents aren't well off, what amount of support would matter?

the american father has been ordered to pay, he has refused. he has philipino citizenship. lives in RP. when the local sherriff went there he was paid a bribe. he has not paid the support even after the court order. he gets 100% disability. part of his payment is for the wife and child that he refuses to support!!!

Who is paying his disability? You need to place a lien on those payments.

the us government, I have spoken w/ the dept they say nothing that the us has no jurisdiction.

Go ahead and find out which bank which is processing his disability payments and place a lien on those accounts.

If it has already been ordered by the court it is my understanding that the Lawyer is the one to enforce it.

No, there is no such agency. You have to get a judgement from the court, locate any assets, get a writ of execution from the court to seize those assets, and find a sheriff to serve and execute the writ.

I have found the Filipino court system somewhat chaotic to say the least. You could spend years trying to get a judgment. :blink:

That's true! They like to drag their feet, knowing you can't afford to pay the legal fees, and wait for the last minute to pay, if they pay at all. Sometimes, they even try and shoot the sheriff when he shows up!

Sad to say, our Philippine laws include child support but is not strictly adhered to, unlike here in the USA. However, you can go back to court and file a motion for the enforcement of the judgment and this time include the bank where his disability is being deposited so the amount adjudged can be garnished . Make sure that the judgment has already become final and executory for it to be enforced.

Yes, the US government has no jurisdiction over him since he is in the Philippines.
