Is it a WITHDRAW better than a DENIAL?

Hi,

As some of you know, my wife filed for divorce while my N400 is pending;

- Many posters advised me to show up for the interview and tell the IO

my marital union is now broken and see what is the outcome;

this scenario = DENIAL of N400 with chance to reapply;

- Many others said I better call the 1800 number and schedule an infopass

to WITHDRAW my N400;

Is it a Denial worse than a WITHDRAW? will CIS see a Denial as a NEGATIVE

record on my file?

Please advice, your opinion is appreciated;

You were given good advice in your post yesterday. Nobody can tell you for sure that all will be ok or not. You have been told about others in your situation who have gone to their interview and were granted Citizenship.

Maybe you should make an appointment with a immigration lawyer and see what they think. But it is up to the interviewing officer on the day.

Timeline

If you're denied because you got divorced after you sent in your application it's not a permanent black mark on your record. They'd just tell you that you weren't eligable any more and to come back in the appropriate length of time to file by yourself. There's nothing negative about it at all - it's just bureaucracy.

STAGE 1 - Applying for K1 (15 September 2003) to K1 Approval (13 July 2004) - 9 months, 29 days (303 days)

STAGE 2A - Arriving in US (4 Nov 2004) to AOS Application (16 April 2005) - 5 months, 13 days (164 days)

STAGE 2B - Applying for AOS to GC Approval - 9 months, 4 days (279 days)

STAGE 3 - Lifting Conditions. Filing (19 Dec 2007) to Approval (December 11 2008)

STAGE 4 - CITIZENSHIP (filing under 5-year rule - residency start date on green card Jan 11th, 2006)

*N400 filed December 15, 2011

*Interview March 12, 2012

*Oath Ceremony March 23, 2012.

ALL DONE!!!!!!!!
