Received this in my email box today. Does it follow the same time schedule as the other petitions in order of review?

The letter means that they updated your case status in their computer system. The I-129 F petition for Fiance is seldom reviewed by California Service center. This is just formality , and if you are visiting your fiance soon this is very good.

returned cases has no 'schedules", no one knows when they will review it. So most of the time they let the petitions expire and then they cancel it. You may get lucky to receive a notice from USCIS that the oetiton expired and you are free to refile...

yeah, it is technically expired so we will try to get married this time to avoid more wasted time. but we think there is a 30 day waiting period in india. too bad it isn't like vegas.

The 30 day rule stinks! Can you see if you can give the notice on this trip and have everything ready for the next? I think [could be wrong] that you need to give at least 30 days, not 30 exactly. This way you'll be all set when you return.

Yeah, if there is absolutely no way around it, I already have a copy of my birth certificate, will pick up my passport size photos, will make a copy of my passport and visa before I leave so he can hold on to it until we are ready. Or if, by chance they let us submit a few months in advance, that would be good. But the best would be if we could get married this time, and save me one more trip, not that i mind seeing him, but i have at least 2 other trips planned after marriage, so it would save money. i wonder how many trips i have to make to get to my free frequent flier miles, lol. He is going to the court tomorrow to pick up the paperwork so i can sign whatever i need to. and as long as we both don't have to be there to turn it in, all is well, and none the wiser.

We plan on making one trip to the embassy, probably friday or monday after I arrive to get the no objection letter for marriage. They (senators) wrote emails to the embassy, but it didn't work. Can I go ahead and send another package back to USCIS? I was unsure about that. I don't mind doing so since I will be coming back with a lot more proof including pictures with his parents while they are still in town (they have been there since early January, and he told them I was coming, so they are staying until the 16th). I would love to plead my case to USCIS, but I didn't know if they will accept it without specifically asking for it. Everyone has told me that California does not review K1s after expiration.

Yeah, that is our next step. He is going to the courthouse tomorrow to find out if it is possible for this trip. If not, I will make another trip in about 6 months (to give USCIS time to expire officially) and we will get married at that time.

You just have to make sure it expires and doesn't get denied. If you can get a confirmation about the expiration, then it's cool to just get married and refile with all that evidence you are compiling. . . Maybe if you get the Senator/House rep to write a letter requesting confirmation of the expiration, stating you just want to get married and refile it could help. . .not sure.

one_heart, she still has to pay attention to the k1/129F if it doesn't expire and gets denied they will automatically deny the I-130. . .don't oversimplify things.

kaushalia--As long as it is reaffirmed or it expires your plan is golden!

hmmmm...would there be a point to call USCIS before I leave and ask them to note on their system that i am going to be with him very soon, and will be prepared with more evidence? or is it pointless?

My situation was the same. I got turned down and my petition was sent back for no particular reason. We involved senator in our case as well as we did all the things 9advise) written in this website. I advise you to act as quickly as possible:file FIOA, get the senator involved, etc. Then you can get married but let them (USCIS, DOS) see that you really care.

We got married and refiled and got approved. My hubby was with me in the interview as well. And now we are together .

No wedding bells for us this trip. He found out the only way we could bypass the 30 day waiting period is if both sets of parents could be there. In India, the 30 days is to give the families enough time to object to the wedding. It is too late for my mom to get her passport, visa, and buy plane tickets. Plus, I can't convince her to go across the country, let alone around the world. But we can turn in our paper work this trip, and it is good for 1-6 months. It all works perfectly to give USCIS more time to review, and I will have my Senators contact them in about 4 months to see if the case is expired. I know, I am praying for a miracle. The positive side is, it only took them 4 months to approve the first time when they said they were 8 months behind last year when I first applied. Now that they are saying 6 months, maybe by some miracle....I will never give up hope. And no more of this 16 months in between visits, what was I thinking?!?!
