Very difficult to reply given the limited information you have supplied.....eg did your spouse enter the US legally? IMO, a consultation with an immigration lawyer to determine what course of action you should take given all your circumstances would be the best bet.

Oh, yes...sorry...he is still here. he entered the US about 7 years ago legally and then just stayed here. i suppose i just need a laywer:) thanks!

If your spouse enter in this country legally, then there won't be any problem, but if your spouse enter illegally, then it is no possible to adjust the status despite the marriage to you, the US Citizen. But I would consult a lawyer.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Damn 7 years ago!!!! As an illegal Immigrant!!! Wow I cannot even live 2 months in the US as a legal immigrant I just cannot imagine being an illegal one. :huh:
