Hello Everyone

This is Gabriel (beneficiary), and we need some advice here :blink: . We were thinking about filing pretty soon, perhaps next month. My girlfriend is coming to Venezuela this coming April so we were planning on including her plane ticket in the package, but then I ran into this post (can't remember which one) that said that plane tickets themselves can't prove she has really entered into the country, that we should attach a copy of her passport with the stamp of her arrival in Venezuela and if it was possible highlight it!... Anyway do you think it would be better if we wait after April to file for K1 so we have better proof that we have met, maybe we will have more recently pictures of us since last time she was with me was in June 2007!!!

pictures is the best way to show that u two are actually together, include some pictures of you two + family in some of the pictures also... so wait for her to arrive take some pictures... then you can include with airplane ticket stub and passport stamps. Good Luck

Well we actually have pictures to show them of us together and with my family from last time she was here (july-september 2007) , but I was just wondering if it'd be better wait and show them that she's been here more than once! especially now that it's getting closer to the 2 years mark!!.

for the initial filing, you need to prove that you and her actually been together within 2 years, so if the pictures, air plane tickets, passport stamps are not over 2 years then you are fine.... and then for the interview, you will then have to prove that your relationship is real, so you can show them how many trips she made to see you.

YEs we are keeping an eye on EVERY detail! we're checking that guide a lot!!!... right now we are just collecting up all things we need and hopefully in a few weeks start working on the actual package to send to the USCIS .. :) dont worry I'll remember your advice!!!

The "been here more than once" is crucial. You will be dealing with a Latin American consulate. Caracas is (at this time) allegedly one of the better ones, but this may not remain true after your I-129F petition is approved and you reach the consular stage. Do not count on one (stale) visit being enough!

The airplane tickets, luggage receipts, and passport stamps are your strongest evidence. Also, even consider taking a photo of the two of you holding a daily newspaper, with its date visible.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

buy a camera that has time stamp, then go to some famous places in your city to take some pictures, then you are fine...

If you were in Ecuador, I'd be 100% serious... and such evidence still might not be enough to satisfy the consulate there. The compromise suggestion about the camera with the time-stamp is excellent -- do that, if you can.

Cameras with time stamps can be manipulated. With photoshop or like software, I can put any date on any picture and put you with anyone you want at anytime, anyplace. Once again.... pictures are secondary evidence and will be treated as such. If you send only photos you will receive an RFE for proof of having met. This in the form of passport stamps, itinerary from airlines, hotels...etc. All evidence that can be easily backed up by the organization.

TBone is familiar with higher fraud posts and his suggestions are on target. You may think your relationship is easy to 'prove' but trust that higher fraud posts will scrutinize more than others and any and all evidence you have should be used. Familiarize yoruself with the Embassy you will be dealing with by checking the Embassy reviews link.

You can file as long as you've met within the last two years, then use your April trip for more proof of ongoing relationship.

I replied in your other post before seeing this one. The second visit in April will help solidify that your relationship is ongoing. Plus I'm sure it will be a great time for the both of you. You were going to be close on the 2 years without this planned trip.

Is Venezuela considered high fraud for K1? If so, start gathering all you can. Won't need it so much for the initial filing, but can be helpful later on. And don't toss out anything that can show that you've been together or communicating. The advice I followed was they can only evaluate the information that is presented. A liitle too much is better than not quite enough.

Photos on different days, in different places, with different people are good. Are there any engagement customs in Venezuela that you two can participate in? For example the engagement ceremony in Vietnam is a BIG deal. So photos from that were very helpful in our case.

You generally are very supportive and give good answers. However, this is several times now that you've been corrected after making statements like the above. Pictures are definitely considered by USCIS to be secondary evidence. Also airplane ticket stubs are secondary evidence because they show only that a ticket was purchased.

Gabriel and Jen,

Primary evidence includes "boarding passes", passport stamps, receipts in country etc. Sure, include some pictures together and with family but initially you only need to show evidence you met once in person. Subsequent visits go to showing a bona fide relationship. With only one visit, I'd show some chat logs and communication examples to go with the evidence of meeting.

Facts are cheap...knowing how to use them is precious...

Okay! So basically for the I-129F packet, we just need to prove that it's a legitimate relationship? For that we should use primary evidence such as boarding passes, passports, hotel receipts and secondary evidence such as pictures and chat logs, etc?

So we could mail off the paquet before my visit in April- but of course take lots of pictures and save every receipt to show as proof of an ongoing relationship?
