Anyone gotten a visa approval

Has anyone gotten a K-1 visa approval with only ONE criminal charge on their record? If so, what happened? My fiance has only ever had this ONE charge on his record. He was married to a very controlling person who was crazy and charged him on grounds of assault because he shoved her out of the door and locked it until she calmed down--so she called the police and had him arrested-he refused to come back to her so she took it to court and had him charged with domestic assault. His relationship with her was immediately over -he got divorced from her and never saw her again--He has NEVER had trouble or a criminal record before this nor after this. Will this result in an immediate denial? We are just at the point now that we're waiting on our NAO1 but I need to know if I need to contact a lawyer now and if they can even help us?

Someone please help before I end up in the hospital because I've had a stroke from all of the stress. Thanks!

sorry--we're waiting on our NOA2 we've already gotten the NOA1 (see how upset I am? lol )

I think the best person to answer that question for you is an Immigration attorney. I am sure you can find one and usually the intial consult is free. In my opinion depending how much time as past by and seeing that he has not had any other charges since that one, I don't think it would be a problem. I still think that you should consult an Immigration Attorney and get his professional opinion.

Good luck with you process. My fiancee and I got the K1 visa she will entering the US next week, then we start with the Adjustment Of Status process.

depends on the adjudicator, however there is plenty of time before any decision will be made. As long as you both were honest on the petition and future applications it should be fine.

Having a record doesn't bar someone from being able to do things if they served their punishment. In most cases :)

Emmett Fitz-Hume: I'm sorry I'm late, I had to attend the reading of a will. I had to stay till the very end, and I found out I received nothing... broke my arm.

The only punishment that he was required to serve was to pay a fine of 200pounds-and have the stupid charge reflecting on his record. This is over a year old but not under five years. It IS his ONLY charge EVER.

Now that you've cleared up that this is the foreign fiance, not the US Citizen, perhaps the correct answers can come. US Citizen convictions are not grounds for denial unless they fall under the Adam Walsh Act. The standard is quite different for the intending immigrant. This doesn't sound like a crime of moral turpitude or anything serious enough to cause a denial. Perhaps a waivers expert will be along to give an opinion on this.

so because of just the ONE thing on his criminal record---we will most definately have to file a waiver? This is ridiculous!

My opinion was that it would be good to hear an opinion about whether a waiver would be needed. Where do you get "most definitely needed"?

I suppose I don't really know what I'm saying right now. I'm just having a panic attack for fear of the unknown I suppose. :wacko:

There's lots of information on what kind of criminal record can require a waiver of inadmissibility. Generally the conviction needs to carry a sentence of more than a year of incarceration. Sounds like a 200 pound fine is not enough to meet that standard but what I'm not sure of is if they evaluate the actual penalty or the potential one.
