For AOS it is three years to be filed with the I-864, and bring your last ITR to the interview.

You'll be needing the ITR of 2008 the most. These includes the supporting documents such as 2008 W2s and 2008 Form 1040 if he already have it.

If unavailable, the least 2 years of tax returns and the supporting documents per year of income tax would be enough..

:thumbs: I agree, it is unnecessary to submit all 3 years of tax returns. The most recent tax return will also include a comparison from the previous two years anyways. It might be a good idea to submit prior year tax returns in the case that most recently filed tax return is borderline or it would be necessary to file prior years in the case that the recently filed tax return is insufficient to meet minimum requirements.

You are correct. Only the last ITR is required, unless you are self-employed. But, I strongly reccommend sending in three years of returns. You will have to bring your previous returns with you to your AOS interview if you do not do so.

When in doubt, check the (I-864) instructions. :thumbs:

25. Federal Income Tax Information.

You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year.

If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years.

Note: I think many folks simply submit 3 years worth from the beginning just for piece of mind. It's a personal choice and depends on your financial situation.

If your ITR Last year is GOOD you dont have to submit the other previous ITR. The only requirement is the latest one.......But then if you want to submit the other ITR its OK too ;)
