affidavit of support using new business and w2s

Hello everyone,

NVC has recently received the petition from USCIS and gave me an MNL number today. So i am preparing documents i need during my interview. we are woking on the affidavit of support now. My question is, my fiance started a business in Guam its for a media service last July 2008. He is also working at the same time. he earned 35,500 plus for the year 2008. My question is, since the 2008 just ended and w2s are yet to be mailed and if in case I should have it before my interview like around febuary, it might take a couple of weeks before my fiance completes preparing his ITR for 2008 so my fiance might not have enough time to file the 2008's ITR. can we just show his paystubs, w-2s and the filed taxes for the newly set up business and his 2007 income tax return? Is it ok if the business is just new but is earning enough money together with his jobs to reach the 125% of the poverty guideline.

He only worked there for like 6 months only and he is now here in the Philippines since November since his business is making money in Guam. HIs new business makes more money than his job. is that ok? he wants to wait for me then fly back to US.

evidence would be the filed gross revenue tax every month. In guam, when you have business, you file your earned income from this business every 20th of the month and pay corresponding tax due. last 2008, he earned 31k plus from the business that he currently have. He is currently not with that previous job since he is here in the philippines right now. this january 2009, even if he is here in manila, his business earned 2,500 gross revenue. can he bring his w-2s for his previous job and filed gross returns from the business last year nd january 2009's gross revenue tax filed?

You keep asking what he can bring and fail to notice the key factor is his current income. It would help if the two of you actually looked at the I-134 to see what I'm talking about. It asks him to declare that he currently derives $X income from X source. "Gross Revenue" can be but usually is not "income". It can be, in a service business with no overhead but I take it he knows the differnce and needs to read the form and decide what his answer would be and what he has to docuement that answer is true.

Of course, he can bring any financial documents he thinks will help them rule in his favor but he must answer that one question truthfully and back it up. I'm always leary when the USC is not involved in asking the questions. He's there with you. It's his affidavit of support. Why isn't he asking these questions?

We are both here and he is also unsure of what to do. He prepared the I-134 last week January 21, 2009 to be exact and the total income he put in there is the total income he had for the whole year of 2008 that is comprised of the income from the two jobs he worked and the income from the business.

Sorry pushbrk because were really confused. Sorry for asking the same questions. If say for example he prepares the I-134 dated February 2009 that will only include income for January 2009 because thats the only current month he can declare, is that how it is or what? If that case, how can that affidavit prove that it will meet the 125% poverty guideline? thank you for the help.

He only worked there for like 6 months only and he is now here in the Philippines since November since his business is making money in Guam. HIs new business makes more money than his job. is that ok? he wants to wait for me then fly back to US.

He can provide tax returns but cannot base his current income on what he earned last year from a job he doesn't have anymore. Does the business provide sufficient income? If so, what evidence can he provide to support the income claim.

evidence would be the filed gross revenue tax every month. In guam, when you have business, you file your earned income from this business every 20th of the month and pay corresponding tax due. last 2008, he earned 31k plus from the business that he currently have. He is currently not with that previous job since he is here in the philippines right now. this january 2009, even if he is here in manila, his business earned 2,500 gross revenue. can he bring his w-2s for his previous job and filed gross returns from the business last year nd january 2009's gross revenue tax filed?

You keep asking what he can bring and fail to notice the key factor is his current income. It would help if the two of you actually looked at the I-134 to see what I'm talking about. It asks him to declare that he currently derives $X income from X source. "Gross Revenue" can be but usually is not "income". It can be, in a service business with no overhead but I take it he knows the differnce and needs to read the form and decide what his answer would be and what he has to docuement that answer is true.

Of course, he can bring any financial documents he thinks will help them rule in his favor but he must answer that one question truthfully and back it up. I'm always leary when the USC is not involved in asking the questions. He's there with you. It's his affidavit of support. Why isn't he asking these questions?

In section 7 of the I-134, he is required to complete the present tense statement, "I derive an annual income of:" Stating last year's income is not a present tense answer. A present tense answer would be to annualize the "income" not "total revenue" derived from his business, since that is his only income in the present tense. Is he at least reading my answers?

NVC has recently received the petition from USCIS and gave me an MNL number today. So i am preparing documents i need during my interview. we are woking on the affidavit of support now. My question is, my fiance started a business in Guam its for a media service last July 2008. He is also working at the same time. he earned 35,500 plus for the year 2008. Frankly, this is a problem that needed a solution in mind before leaving the former joba and going to he PI. You can try basing everything on last year and taking your chances.

Frankly, this is a problem that needed a solution in mind before leaving the former joba and going to he PI. You can try basing everything on last year and taking your chances.

He had a talk to his employers today and w2s are to be sent this week. so he will be filing the income tax return for 2008 and will just bring supporting documents like bank statements showing deposits for the past year and the current balance plus the Gross Receipt for january 2009. I guess we'll just take the chance of basing everything on last yr. thank you pushbrk for the inputs. it helped us alot.
