I had recently posted under the K3 Spouce Visa thread found here... http://www.visajourney.com/forums/index.ph...amp;hl=eklondon

I don't know what I would have done without visajourney.com. Thanks to everyone so far who has provided information. Still need some help as this stuff scares me. I don't want to miss a beat, I already miss my family too much.

I am putting together the initial I130 Packages to send away and wanted to make sure I had everything that is needed. This package will include a petition for my Wife and 3 kids.

As per the guide

1. Payment as required by USCIS. Use a check so you can track the payment.

2. Form I-130, Petition for Alien Relative (see example form)

3. Copy of the Birth certificate for the US Citizen (front and back) or a copy of ALL pages of the US Citizen's passport. This is used to establish citizenship. You may use a copy of your naturalization certificate or certificate of citizenship issued by USCIS.

4. A copy of your marriage certificate (If not in English then again get a translation)

5. If either you or your spouse were previously married, submit copies of documents showing that all prior marriages were legally terminated.

6. A copy of a prior spouse's death certificate. (If one or both were married before, and the prior spouse died)

7. G-325A (all four pages) filled out by the US Citizen signed and dated

8. One passport-type photo (see specification) of the US Citizen. Write the full name of the US citizen on the back. Place in a plastic bag and label the bag "Photo of ". Attach the bag to a sheet of paper and place behind the corresponding G-325A.

9. G-325A (all four pages) filled out by the foreign spouse signed and dated

10. One passport-type photo (see specification) of the foreign spouse. Write the full name of the foreign Spouse on the back. Place in a plastic bag and label the bag "Photo of ". Attach the bag to a sheet of paper and place behind the corresponding G-325A.

11. Evidence of a bonafide marriage (see note below for what to include)

What I have

1. Payment for all 4 petitions (can this be one check?)

2. Form I130 for all 4 relatives

3. Copy of both short and long Birth Certificates for all 4 relatives

4. Copy of both short and long Marriage Certificates

5. Does not apply

6. Does not apply

7. G-325A filled out by me (US Citizen)

8. My mug shot (Passport type photo) in a labeled baggy

9. G-325A filled out by Canadian Wife

10. Beautiful Passport type photo for my wife, Bagged and labeled

11. Photocopies of both mine and my wife's Drivers licenses showing the same address in Canada

Photocopies of our mortgage together - Welcome Letter of initial mortgage date and a recent Mortgage Statement of Account

Is there any additional documents that I should send?

It seems as I am missing something for my kids petitions as all I have for them is the I130s and Birth Certs

I also have Copies of my kids Canadian Passports (just the photo page) - Should I send this?

How should I put this package together, should I have everything in order as above or a keep each petition as a separate?

Do I need a cover letter to submit the I130s?

Should I write a brief description of my situation?

Thanks

Four separate checks affixed to four separate petitions all in the same envelope.

Include a copy of the marriage certificate as evidence you married the child's natural parent and passport picture for you with each of the childrens' petitions as well. Although it's not clear that it is needed, I would include a G325a for the US Citizen with each child's petition as well. They'll all be identical anyway.

I would have a cover letter for each petition and a short cover letter over all four, indicating what will be found in the package.

It's not clear to me how it is your wife has three children but was never previously married. You said divorce decrees and death certificates were not applicable. If the children are illigitimate, so be it. I just wanted to double-check that the items are not applicable. Perhaps you are the father but the children don't qualify for citizenship through you. Please clarify.

My wife and I are the biological parents of the children. Because of me not living in the US for at least a 2 year period after my 15th BDay, my kids do not become automatic Americans

That would be the answer then. Provide a copy of your marriage certificate with each of the four petitions.

Also a quick question, read this on the I130 Instructions guide and I feel it pertains to my situation,

"When will a Visa become available?

When a petition is approved (I'm assuming for the I130s) for the husband, wife, parent, or unmarried child of the US citizen, these persons are classified as immmediate (the instruction guide has a spelling error) relatives. They do not have to wait for a visa number because immediate realitives are not subject to the immigrant visa limit. "

Does this mean the process will not take as long as others I have seen?

ty, I will start utilizing the timeline feature once the petitions are mailed.

In the meantime any other suggestions are appreciated.

Most of what you see here are people who don't need to wait for a visa number. You'll be in the same boat as others filing for spouse, children or step-children. Other relatives' wait for a visa number is counted in years.

Previously I found a thread about creating a cover letter and now unable to find it. Would anyone have the link (if one exists)

From my Understanding I will need to submit a general Cover, then a cover for each of the four petitions

Main Cover

Purpose: Original Submission - Petition for Alien Resident

Form Type: I130

My Information / Address / Phone

A. ORIGINAL SUBMISSION - Petition for Alien resident - Spouse of Petitioner: Spouse's Full Name

B. ORIGINAL SUBMISSION - Petition for Alien resident – Child of Petitioner: Child's Full Name

C. ORIGINAL SUBMISSION - Petition for Alien resident – Child of Petitioner: Child's Full Name

D. ORIGINAL SUBMISSION - Petition for Alien resident – Child of Petitioner: Child's Full Name

--------------

Then each additional cover would include

--------------

A. Purpose: Original Submission - Petition for Alien Resident

Form Type: I130

My Information / Address / Phone

Petition for Alien resident - Spouse: Spouse's Full Name

• Payment check of $355

• Completed I130

• Birth Cert

• Marriage Cert

• Completed G-325A Spouse w/mug shot

• Completed G-325A Mine w/mug shot

• Evidence of a bonafide marriage

------------------

(the next 3 will look the same except for the names)

B, C, & D, Petition for Alien resident - Child of Petitioner: Child's Full Name

Looks good. Please note that the passport picture has nothing to do with the G-325a, so would have it's own line in the list. The logical place to put it is in a bag, statpled to a full sheet of paper placed behind the G325a. The placement is logical only because the picture is mentioned after the G325a in the list of required documents, not because the two are connected in any way.

G325a question

It is required that I send a passport type photo along with the G325a forms.

My question is what is required on the reverse of the photo?

Initially when I got the photos done, the photographer stamped the back with the current date (no it has been passed 30days from the photo), as I read along through these forums I find contradicting information. Should I just print the Name and date on the reverse side, should it be in pencil or felt-tip pen (I remember once seeing that the felt tip pen was rejected and was advised to use pencil)?

Also I am unable to find the g325a guide to assist as I need to get more photos again.
